Scope of Position: The primary responsibilities of the Environmental and Litigation Counsel will be advising clients on environmental legal issues and handling litigation, including the management of complex litigation and pre-litigation advice with respect to environmental matters. The position may have responsibility for general commercial litigation matters from time to time as well. Day to Day Responsibilities: - Advise on environmental and safety matters globally.
- Assess liabilities and reduce risk through pre-litigation advice or litigation.
- Manage legal aspects of corporate environmental compliance audit program.
- Act as the primary interface between the company and our law firms in environmental litigation matters pending in courts and administrative agencies.
- Manage outside counsel prior to and during litigation to ensure high quality work, cost effective use of resources and appropriate focus on successful strategy.
- Set strategy and develop substantive positions taken by counsel. Review and edit briefs/arguments submitted by counsel, and analyze information from witnesses and documents.
- Supervise processes for data collection.
- Ensure the best evidence and arguments are posed to the court or other authority. Simplify presentations and make them compelling.
- Identify strategic alternatives/options for the business relative to litigation and dispute resolution.
- Keep business clients updated and engaged, where needed.
- Prepare litigation matters for trial or negotiate favorable resolutions.
- Prepare budgets and provide input for financial reporting.
Travel Requirements: Some travel is required (domestic & international), and the amount may vary month-to-month but is unlikely to exceed 15% on an annual basis Required Education, Qualifications: - JD from an accredited law school
- Member in good standing of at least one State Bar
Required Years and Area of Experience: - 5 to 8 years of experience in litigation and environmental law advice
- Experience in in-house legal department, law firm, or government
Required Skills: - In-depth understanding of environmental law and state/federal regulations.
- Some experience with international environmental regulation, including regulation of products, preferred
- In-depth understanding of environmental litigation issues and knowledge or procedure and practice
- Effective leadership, organization, and planning skills, with ability to handle changing priorities
- Excellent communication, interpersonal, and influencing skills
- Excellent writing and advocacy skills
- Ability to assess and quantify risk
- Demonstrated track record of on time delivery within budget; ability to drive projects to successful conclusion
- Must be a self-starter, ability to work in a collaborative team environment and ability to motivate others
- Solid leadership and negotiating skills
- Creative problem-solving
- Ability to ascertain trends and significant issues from data
- Strong attention to detail
