The Privacy Counsel is responsible for the development and management of a comprehensive enterprise privacy program that is resilient to changes in business practices, regulations and privacy expectations while enabling consistent, effective privacy practices which minimize risk and ensure the confidentiality of protected information across the organization.
Core Job Responsibilities
Develop, implement, and manage a strategic and comprehensive enterprise-wide privacy program that enables consistent, effective privacy practices which minimize risk and ensure the confidentiality of protected information across the organization . Privacy Counsel will have primary operational responsibility for the Company’s privacy program, provide consultation around new service and product development, guide strategy, develop and operationalize policies around the collection, use, storage and disposal of information and act as a key educational leader for privacy strategy and operations.
Develop, implement, and manage a strategic and comprehensive enterprise-wide privacy program that enables consistent, effective privacy practices which minimize risk and ensure the confidentiality of protected information across the organization.
Maintain privacy program documentation, including records of processing, privacy notices, policies, procedures, incidents/ breaches and data protection guides.
Investigate potential data privacy incidents, identify applicable legal obligations, and execute data breach response plan.
Negotiate, draft and review the data privacy and security aspects of contracts with internal and external business partners to effectively manage and mitigate privacy risks via contract terms and conditions across a wide spectrum of clients and vendors, develop standard provisions, and escalation processes.
Develop and manage procedures for vetting and auditing vendors for compliance with the privacy and data security policies and legal requirements.
Perform privacy impact assessments and advise the business on privacy controls. In connection with acquisition activity, lead due diligence and integration efforts relating to data privacy and security.
Lead training and awareness efforts as needed and/or required to increase employee understanding of privacy policies, data handling practices, and legal obligations.
Conduct regular privacy program assessments to identify gaps in compliance and risks to the business, and work with the business to mitigate findings.
Monitor emerging privacy concerns and/or threats, respond to legislative changes through regular reviews and revisions of privacy policies and internal processes, and advise relevant stakeholders on appropriate courses of action.
At least 10 years legal or privacy experience with a minimum of 5 years working the privacy field.
In-depth understanding and working experience with privacy compliance guidelines and regulations including HIPAA and GDPR.
Experience with CCPA, FERPA, TCPA, FCRA and the NIST standards preferred.
