Position Description:The Director, Legal Affairs acts as in-house attorney, providing legal counsel related to employment law compliance and litigation, to the various and distinct U.S. companies of the LVMH Group including the following:
Advise Group brand clients on all aspects of federal, state and local employment law compliance.
Provide practical solutions to Group brands in order to meet business and best practice requirements while minimizing legal risks including as related to discrimination & harassment, accommodations & leaves, investigations, safety, termination & severance, hiring practices, employee policies and handbooks, wage & hour, performance management, employment related contracts, restrictive covenants, executive compensation and others.
Track, research and advise on key employment law developments, draft employee handbooks, manage the disability interactive process, and draft employment related agreements, including severance/separation agreements.
Assist in the management of the Group employment-related litigation docket including, arbitrations, administrative actions, mediations, demands and legal threats. Coordinate and assist in management of outside counsel, legal holds, and EPL insurance claims.
Provide training to human resources, managers and employees on various employment law-related subjects including discrimination & harassment, general employment law compliance and updates.
Reporting:The position reports to the Vice President, Legal Affairs – Employment Law
Location:This a New York-based position and candidate must live within commuting distance to NYC.While the successful candidate may start working remotely, this will not be a 100% remote working position and some office time will be expected in the future.Relocation benefits will be considered.
The candidate should have a practical, solutions-driven counseling ability with an exceptional and upbeat, client-service-oriented approach. The candidate should also demonstrate independence, confidence and ability to manage legal and business priorities and help build consensus among multiple stakeholders.The position requires working in a fast-paced, multi-tiered corporate structure, so the candidate should be comfortable with multi-tasking and dealing with ambiguity, all while maintaining a marked sense of humor.
4 - 7 years management-side, employment law experience in a full-service or boutique employment law firm.
Experience counseling clients on, or solid understanding of, various substantive areas of employment law including:
Basic legal facility with issues related to discrimination and harassment, disability leaves and accommodations, employee policies, and wage and hour matters.
Some facility with employment-related agreements such as offer letters, employment contracts, severance, confidentiality and contractor agreements.
Excellent written and analytical ability is expected with some experience drafting position/mediation statements and/or dispositive motions, or similar.
Strong legal research capability especially as to keep track of the influx of recent employment law developments particularly related to COVID regulations, family leave, sick leave, pay equity, harassment and others.
Experience as management attorney on employment-related litigation including discrimination and wage/hour claims.
Experience is the following areas is preferred but not required
Providing employment-related training
Performing or managing investigations
Employee benefits law and processes
California employment law
Wage and hour class action litigation
Labor union issues
Canadian employment law
Working with a multi-national group and/or providing legal guidance to non-U.S. stakeholders
