This Senior Counsel, Information Governance will be a new position at Emergent on the Global Employment Law, Litigation & Information Governance team. The position will serve as the legal representative on cross-functional teams for establishing and managing information governance processes such as data classification, records management, legal holds, and eDiscovery, as well as managing or assisting with all non-intellectual property litigation and advising on privacy and cybersecurity issues.
ESSENTIAL FUNCTIONS

Advise on data protection, cybersecurity, incident/breach response, business continuity and the protection of company assets through the use of cutting-edge technology.
Work with cross-functional teams to assess, design and implement technology and processes for Records Management including retention schedules, Legal holds, and eDiscovery for pre-case assessments, administrative proceedings, investigative matters, and litigation with a focus on compliance and litigation readiness
Advise on appropriate retention and destruction policies and processes of various types of data and information
Manage third-party subpoena responses
Assist with employee and dispute escalations, alternative dispute resolution, and pre-litigation and litigation matters
Work closely on global Privacy legal obligations with other legal team members, members of Ethics and Compliance, and IT Security (especially around data mapping and responding to data subject access requests)
Monitor and share best practices and trends on legal issue regarding information governance and cybersecurity
Identify opportunities to enhance effectiveness of legal department operations.
Communicate, educate and train on technology solutions/processes
Help drive performance of business objectives by identifying possible solutions for identified legal issues
Actively participate in department initiatives and devise scalable processes to support busy legal department
Retain, supervise and direct outside counsel and other third-party vendors effectively and efficiently managing legal expenses consistent with the Legal operations budget.

III. MINIMUM EDUCATION, EXPERIENCE, SKILLS
Law Degree from an ABA accredited school and licensed and in good standing in at least one U.S. State
5-10 years of legal experience in a law firm, in-house and/or government setting
Significant experience working on setting up and/or overseeing processes/software tools for at least 2 of the following: e-Discovery, data classification, contracts management, and records management
Significant experience working with IT/ Information Security teams on programs, policies and processes
Significant litigation experience in U.S. state and federal courts
Experience with working with teams to implement technology for legal departments and clients/customers
Familiarity with privacy law and cybersecurity
Preferably experience with US and global issues
Strong interpersonal skills with the ability to effectively work in a matrix team environment
Strong organizational and prioritization skills in order to effectively manage multiple projects in a fast-moving, quickly-changing environment and communicate across functions effectively
Excellent judgment, analytical and strategic thinking skills
Ability to work well in a fast pace, changing environment with confidence, focus, efficiency, and accountability
Motivated self-starter who can ask important questions, exercise good judgment, make decisions, and follow-through to completion of projects in an expeditious manner.
Strong and consistent attention to detail
Willingness to pitch in on varied legal department needs
Strong ability to grasp legal issues quickly, exhibit strong analytical problem solving and decision-making skills, exercise sound judgment, and provide practical and constructive legal advice in a time-sensitive, dynamic, and fast-paced complex environment.
Strong negotiation and communication skills (both oral and written). Ability to communicate legal and technology issues in a clear and understandable manner to attorneys and non-attorneys.
Ability to build relationships across functions and sites and inspires trust and confidence through effective communication and interpersonal skills.
Strong work ethic and ability to manage large workload, focus on critical priorities, and otherwise effectively meet client needs directly and with members of the Legal Department.
Defines success in terms of team goals, adapts quickly to changing resource requirements, has a clear understanding of other groups’ business priorities, and uses knowledge of organizational culture to achieve objectives.
