The Association of Corporate Counsel (ACC) is the world's largest organization serving the professional and business interests of attorneys who practice in the legal departments of corporations, associations, nonprofits and other private-sector organizations around the globe.
This position is responsible for leading the Litigation Practice Group that is part of the Legal Department. The Litigation Practice Group is comprised of two divisions, one comprised of attorneys and paralegals who manage enterprise and employment litigation, and the second, Public and Professional Liability or PPL, comprised of claims examiners overseen by attorneys, who manage the defense of Kaiser Permanente’s medical malpractice and personal injury claims.
This position oversees and advises senior management regarding high-risk litigation matters and litigation reserves. This position shares joint accountability with other Legal Department Practice Management Team members for ensuring the Department’s provision of high-quality legal services, achievement of the highest levels of customer satisfaction, as well as for setting Department priorities, establishing and managing the Department budget, and controlling costs. In recent years, due to increasing healthcare regulation and enforcement, this position needs to have particular expertise in managing government investigations and actions, class actions, white collar crime matters, and other high-risk or high-profile litigation. Traditionally, this position also has been a leader regarding diversity in corporations and the legal profession.
Manages the work of the Litigation Practice Group, including:
Assuring that cases filed against Kaiser Permanente are managed in a manner that best protects the Program with respect to reputation, impact on operations, and cost.
Collaborates on enterprise litigation strategy.
Management of litigation on a risk portfolio basis, aligning the litigation resources of the Legal Department and Program with the risks associated with litigation.
Establishing timely reserves and assuring compliance with Kaiser Permanente policies and reporting obligations with respect to reserves.
Keeping senior management regularly advised of key litigation matters as well as litigation trends and risks; and including senior management as appropriate in strategic and tactical decisions.
In consultation with the General Counsel, selecting and consulting with outside law firms to represent the Program.
Providing direct legal services, including supervision of high-risk litigation and the provision of consulting advice.
Enhancing motivation of legal professionals through maximization of skills, providing opportunities for recognition and participation in developing Department.
Managing individual performance including performance appraisals and other human resources.
At least 15 years of litigation experience defending major healthcare clients or prosecuting healthcare cases on behalf of the government, preferably including (1) False Claims Act litigation; (2) service as lead counsel in state or federal trials, (3) litigation of class actions, and (4) litigation of high value cases.
Demonstrated excellent performance and success in conducting litigation. Excellent legal judgment.
Experience in managing large teams of attorneys and other professionals.
Demonstrated qualities consistent with the Department’s preferred operating style, i.e., mutual respect, fairness, honesty, ethical behavior, independent, creative thinking while operating as a team member.
Excellent inter-personal skills with clients, co-workers and subordinates.
Consistent high ratings from customers, peers, and subordinates.
Excellent verbal and written communication skills
Demonstrates high emotional intelligence and the ability to generate enthusiasm and commitment among colleagues
California State Bar license or willingness to obtain California State Bar license required.
Excellent academic and professional qualifications.
In-house experience managing portfolio of litigation helpful. experience strongly preferred.
Familiarity with medical malpractice and administration of claims helpful.
Big law firm training a plus.
