We are seeking an experienced Senior Deputy General Counsel who acts as first Deputy to Chief Legal Officer and is responsible as Director of Litigation Operations for day-to-day management of the legal and litigation affairs of the corporation.
As Director of Litigation Operations, this position provides counsel, advice, oversight and management of litigation matters, claims, adverse actions, discovery and related activities. As Senior Deputy General Counsel, the position provides specialized advice and expertise on employment, ERISA, pension, trust and labor issues for corporate P.C., subsidiaries, plans and fiduciaries. The Senior Deputy General Counsel also provides counsel, advice, oversight and management of general business, corporate, health care matters and advocacy for NWP’s legal positions. This position directs, oversees, manages corporate personnel, outside counsel, advisors and vendors on litigation, employment, pension and labor matters. This position is committed to a collaboration with Permanente Federation, Kaiser Regional and Program Office Legal departments for health plan and hospital entities, including its counsel, compliance staff, HR, Labor and Employment and Governmental relations personnel. This position establishes and strengthens relationships with federal, state and local executive, legislative, regulatory and judicial officials.
Major Responsibilities / Essential Functions
Director of Litigation Operations
As Director of Litigation Operation for NWP, its physicians, clinicians and employees, subsidiaries and strategic relationships. Oversee defense, advocacy, resolution of claims cases, complaints, and disputes. Select and oversee outside counsel engaged on a variety of matters related to legal, litigation, claims and issue analysis.
Managing Counsel on litigation, disputes, controversies, arbitrations, settlements, third-party litigation, workers’ comp and other non-medical malpractice litigation involving NWP physicians, employees, records, and corporate business and activities.
NWP Counsel for medical malpractice litigation involving NWP physicians and clinicians; participation on and legal support for Claims Resolution Committee and Medical Director of KPNW Risk Management and Patient Safety.
Oversee litigation personnel, direct their activities, workplans, training, document and advice. Oversee outside counsel in litigation and disputes including conducting discovery, representing NWP at trail and hearings, setting strategy and outcomes, retaining experts, counsel and other professionals as needed, complete file management.
Assists the NWP General Counsel in setting strategy and meeting the overall legal and litigation needs of the medical group.
Oversees the Legal Department’s litigation, dispute resolution functions including but not limited to budgets, reserves, approvals, reporting, recruiting, and other related functions.
Ensures investigations, defense and disposition of claims and lawsuits including those related to employment and business matters affecting NWP.
Responsible for overseeing, directing, managing and triaging litigation matters handled by attorney and paralegal personnel (in-house and external), as well as the day-to-day performance of subordinate personnel and contracted vendors including outside counsel. Management, selection and evaluation of outside vendors including outside counsel for litigation. Strategic planning for the department including development of department goals, metrics, performance evaluation activities. Implement and maximize use of litigation tools such as but not limited to litigation matter management tech solutions.
Senior Deputy General Counsel
Responsible for areas of Employment, Human Resources, Pension and Benefits, Collective Bargaining Agreements, Labor Agreements, complex disputed financial matters, and general back-up to Chief Legal Officer.
Oversee, monitor, and advise on draft and review ERISA and plan documents, including but not limited to Summary Plan Descriptions, Cash Balance Plan documents, employee and beneficiary communications, ERISA compliance and related tax documentation.
Day-to-day legal advice to operations and physician leaders on a wide range of healthcare issues, including Medicare, Medicaid, financial and reimbursement issues, credentialing, licensing, scope of practice, medical-legal issues, peer review, and quality improvement activities.
Support Chief Legal Officer in advising and counseling NWP on corporate matters, including but not limited to analyzing legal and corporate governance issues for the Board of Directors, Board subcommittees, Board-engaged consultants, auditors, outside counsel and experts, Corporate officers and others serving the Boards.
Advice and counsel leadership, clinicians and staff regarding laws and rules affecting group practices, individual clinicians and medical care generally in Oregon and Washington states and under federal schemes.
Develop and participate in training, advisories, documentation, communications and other means of educating personnel on legal, litigation, regulatory and compliance matters.
Juris Doctor (JD) degree
Minimum Work Experience
Ten (10) years practicing attorney in corporate, labor and employment, health care and/or litigation fields.

Experience and working knowledge of legal and policy issues related to Labor and Employment, ERISA, Pension, Plans, Benefit and Trusts in the employment context, Human Resources, and general employment law and matters.

Advanced Degree, education, certification or equivalent work experience in health care (administration, public health, coding, compliance, etc.), public policy, political, regulatory or judicial areas of study.
Preferred Work Experience and Qualifications
Ten (10) years’ experience in legal, litigation, regulatory; compliance, corporate law.
Five (5) years’ experience practicing in federal and/or state court and before federal and/or state regulators and administrative agencies, including but not limited to NLRB, EEOC, BOLI.
Experience running a legal department, personnel, budget, outside counsel and/or other similar leadership position.
Experience handling full range of employment law issues including hiring, discipline, terminations, pay and benefits, grievances, investigations.
