Advanced Sterilization Products (“ASP”) is searching for an Associate General Counsel-Litigation and Labor & Employment (“AGC”) to focus on U.S. and global litigation and labor and employment law matters. The position will also manage ASP’s insurance program. This person will report to the VP & General Counsel of ASP. This position will be based in Irvine, California.
Your Impact • Serve as a key legal advisor to the ASP HR function as well as other business functions. • Provide high-quality legal advice and counsel in a timely fashion to legal team members, the HR department, and business partners on the full spectrum of labor and employment matters pertaining to a global enterprise with significant number of employees in California, including but not limited to compliance matters, litigation, EEO matters, restrictive covenants, immigration, OFCCP and affirmative action, diversity and inclusion, whistleblower claims under SOX and Dodd-Frank, global mobility, employee representative structures and obligations, etc. • Lead or advise on investigations involving labor or employment law issues. • Provide leadership, advice, and creative solutions regarding the Company’s compliance with the myriad of domestic and international, federal, state, and local laws that govern the employment relationship and the workplace. • Develop an understanding of ASP’s operations and ongoing related legal issues to provide meaningful legal support while proactively identifying and mitigating legal risks. • Manage litigation and claims, including the development and execution of effective litigation management (including discovery) and settlement strategies; assist in the negotiation and resolution of pre-litigation employment related disputes. • Track and escalate significant litigation and claims, including appropriate reporting. • Maintain a culture with a high degree of emphasis on integrity, respect, and inclusion. • Work effectively with and manage outside counsel. • Develop and devise best practices, tools, guidelines, programs, and solutions that can be efficiently implemented across multiple locations. • Develop, prepare, and deliver training and educational materials as to labor and employment legal matters such as compliance with various regulations in California, other relevant US states, and internationally, and conduct training for the ASP HR function and other teams. • Provide support on legal aspects of collective bargaining negotiations, advise on unfair labor practices charges, and advise on grievance and arbitration matters related to traditional labor unions. • Provide support regarding employee representative structures, union awareness activities and positive employee relations. • Assists the ASP General Counsel as requested on litigation and other legal matters and projects. • Exhibits and leads on the “Fortive 9:” Customer-obsessed, adaptable, delivers results, strategic, leads with FBS, innovates for impact, inspires, exhibits courage, and builds extraordinary teams.
Our Needs Here’s what we’ll need from you:
• JD from an accredited university and, ideally a member in good standing of the California State Bar • A minimum of 7 years’ experience within legal department of an international company or comparable relevant legal experience; major law firm experience preferred • Specific experience advising on all aspects of California labor and employment law • Microsoft Office (Word, Excel, PowerPoint, SharePoint) • Ability operate autonomously and comfortably in the face of complexity and ambiguity within a fast-paced, quickly evolving environment • Intellectually astute, analytically precise, have a strong bias for pragmatism and possess a broad range of experiences. • Ability to apply business and technical expertise to identify potential issues and partner with colleagues across ASP and Fortive Corporation to help solve problems of significant importance to the company. • Strong written and verbal communications skills, ability to act as a change agent through dynamic interactions with others; comfortable with public speaking. • Ability to prioritize and meet deadlines in a fast-paced, high volume, entrepreneurial, frequently-changing environment. • Unquestioned integrity and excellent judgment. • Culturally savvy and able to work effectively in a global environment and across numerous legal systems. • Process-driven and results-oriented; history of building sustainable and innovative standard work and systems. • Capable of working successfully as a leader, an individual contributor, and a team player. • Strong organizational skills and work ethic, prioritizing and effectively managing time. • Organizational agility; able to work effectively across functions and organizational hierarchy. • Excellent verbal and written communication skills and able to convey complicated advice and information in an understandable and engaging way. • Ability to influence and build followership with associates at all levels.
