As part of the Office of General Counsel, reporting to the Assistant General Counsel for Privacy, Data Governance, and E-Discovery, this attorney focuses on legal support to all business functions of Volkswagen Group of America, Inc., regarding e-discovery and records information management issues. This position will play a key role in providing e-discovery legal guidance, for all VWGoA litigation in the United States, and US litigation involving non-US VW Group entities. In addition to this supporting role, the E-Discovery Senior Counsel will serve as primary managing attorney for certain categories of subpoenas served on the company. This attorney will also advise the business and records management professionals on record retention and governance, defensible disposition, and information risk from an e-discovery perspective.
In addition, this position will serve a core role helping manage the operational activities of the E-Discovery/RIM team at VWGoA, working closely with attorneys, e-discovery specialists, paralegals, and IT to support the team’s: execution of strategic plans, policies, and procedures, training of legal department and company employees, management and integration of technology purchases, and engagement, retention and management of E-Discovery vendors. Finally, this role will participate in the ongoing activities of VW Group’s Global Discovery Center, which aligns group best practices in E-Discovery and RIM for VW’s global businesses.
Apply E-Discovery subject matter expertise when advising in-house and outside counsel on active litigation, regulatory, and investigation matters. (45%)
Review pleadings, understand theories and strategize on proportional limits of discovery
Assist case teams in development of e-discovery strategy consistent with VWGoA procedures, client goals, E-Discovery Best Practices, and case variables
Assist case teams in conducting custodian interviews and follow-ups
Conduct monthly case team check-ins on open matters
Support VW Group non-US affiliates on US e-discovery issues, including by participating in VW Group Global Discovery Center activities
Supervise training of VWGoA’s inhouse counsel and paralegals on E-Discovery “Best Practices”
Assist case team in development of strategy for collection of relevant information for review Work collaboratively with the E-Discovery/RIM team members, case teams, business partners, outside counsel, and E-Discovery vendors to operationalize VWGoA e-discovery strategy, policies, and procedures. (50%)
Support implementation of data preservation policies and procedures within business environment, including continuous improvement through audits and metrics
Review and provide recommendations on legal technology
Manage e-discovery vendor engagements
Manage legal department’s law firm/vendor data retention and audit program
Support records management professionals on implementation and enforcement of company records retention policies
Support and advise on defensible disposition projects
Serve as primary managing attorney handling certain subpoenas served on VWGoA. (5%)
5-7 years law firm or in-house experience
J.D. from leading law school
Membership or eligibility for admission to the Virginia State Bar (including Corporate Counsel certificate)
Understanding of and experience in e-discovery law, procedures, “Best Practices,” and technology
Experience counseling litigation teams (in-house and outside counsel and vendors) on e-discovery issues such as preservation and collection, and operationalizing e-discovery “Best Practices” into an e-discovery compliance program within an organization.
Experience providing legal advice on, and operationalizing, Records and Information Management (RIM)
German language skills
Automotive industry experience
Experience with addressing e-discovery within the context of a global company
Experience retaining and managing outside counsel and e-discovery vendors
Project Management experience
Program Management/analysis experience, including comfort with designing and implementing maturity models and metrics reporting.
Experience addressing privacy law and data security in the context of e-discovery and RIM.
Experience managing outside counsel and vendors, including negotiation of counsel and vendor contracts.
Domestic or International Travel: 15%
