This position will be the key legal counsel on all employment, benefits, and litigation matters for a specialty retail company with operations in the U.S., Canada, and abroad.
Employment & Litigation Counsel
Provide legal advice on a broad range of employment law matters, including hiring, retention, performance management, separations, discrimination, harassment, investigations, accommodations and leaves of absence, wage and hour, and immigration matters.
Prepare legal documents including employment, separation, restrictive covenants and other HR related agreements.
Proactively monitor and advise on new developments in employment laws.
Develop and improve employment law-related compliance processes, policies and guidelines to minimize legal exposure. Develop and collaborate on training.
Lead audits and handle employee-related disputes. Investigate claims and draft position statements, mediation statements, and other documents in connection with employment-related claims.
Manage all litigation matters for the company. Handle all pre-suit matters in-house by investigating claims and gathering relevant information, communicating with opposing counsel, drafting relevant documents, and negotiating resolution.
Manage outside counsel handling all types of litigation, including development and management of budgets, guiding on litigation strategy, reviewing pleadings and other documents.
Assist with responses to subpoenas and similar requests.
Manage outside counsel and budget on all employment and litigation matters.
Perform other employment law and compliance and litigation related duties as required
Education and Experience:
Juris doctorate from an accredited law school
Member in good standing of the State Bar of New Jersey, or a State Bar and able to register as New Jersey in-house counsel
8+ years of employment and/or litigation experience
In-house experience preferred from Retail or Consumer Goods industry
Expert-level knowledge of federal and state employment laws and regulations (including ADA, ADEA, FMLA, CFRA, FLSA, FEHA, etc.)
