We are a growing, nationwide distributor of building materials. The Chief Counsel – Division Operations, Real Estate, and Leasing- will perform a critical role of providing our business leaders with practical, high volume legal advice on contracting and commercial matters as they arise. A large component of this position is managing the Company’s robust portfolio of real estate and equipment leases, including negotiating new leases for new locations, managing and negotiating renewals for current leases as they arise, and organizing and tracking all leases. This position will also support the equipment leasing needs of our divisions. Finally, this position will also partner closely with our business leaders to counsel and advise on day to day commercial legal issues that arise.
The Chief Counsel will report to the Company’s General Counsel. The ideal candidate will have a high level of business acumen in order to work successfully with business partners to manage the leasing function.
Primary Duties / Responsibilities
Overall management of the Company’s leasing portfolio (real estate and equipment), including the creation and maintenance of a tracking system;
Develop and implement simple and streamlined processes to manage lease renewals;
Negotiate, finalize, and monitor of all new leases and lease renewals;
Organize, track, and monitor all key deadlines, including notice requirements, under all leases;
Review and manage environmental compliance issues as they arise in leases;
Identify areas for cost improvement and efficiencies;
Participate, as needed, in due diligence and evaluation for sites selected for greenfields;
Assist in diligence and support transition/ integration in acquisitions as needed; and
Other duties and responsibilities as assigned.
Juris doctorate from ABA accredited law school, plus undergraduate in business or real estate
At least 6+ years of general commercial law experience
At least 3+ years of real estate leasing-related experience in a major law firm or in-house
In-house experience strongly preferred
Qualifications (Knowledge, skills and abilities):
Have an innovative and entrepreneurial spirit and be comfortable multitasking and working in a fast-paced environment
Extensive background in real estate, leasing, and commercial contracts
Possess excellent communications skills and organizational awareness; ability to develop effective and concise materials in a variety of formats (incl. word, vizio, excel, PowerPoint, project plans etc.)
A strong and persuasive negotiator
Must be a leader and a manager, with the knowledge and experience to "get things done”
Outstanding presentation and interpersonal skill, including written and oral communication
Demonstrated problem solving and conflict resolution skills
Strong business acumen and technical IT knowledge to understand business requirements
Ability to thrive in a highly matrix, fast-paced, multi-site organization experiencing rapid growth
Awareness of industry trends and marketplace changes in technology, particularly cloud computing
Ability to work independently; knows when to report/ escalate and how to manage both up and down
