Under the direction of the Chief Legal Officer, the VP Associate General Counsel, Litigation and Employment Law will provide comprehensive oversight, management, and strategic direction on litigation, labor and employment legal services provided by managing attorneys, staff attorneys, and outside legal counsel to the Tribe and its affiliates. The Associate General Counsel will provide strategic support to San Manuel’s outstanding legal/risk/regulatory team and serve as a front-line resource for San Manuel stakeholders relating to a broad portfolio of legal and risk issues. The VP Associate General Counsel will lead and direct San Manuel’s litigation practice including but not limited to employment litigation, business litigation, patron claims and all other litigation activity. This position oversees the strategic development of all legal advice regarding employment and labor law matters in substantive areas including, but not limited to, employee relations, human resources, labor relations, compensation and benefits, and workers compensation. This role will provide leadership to ensure Tribal interests are protected and enterprise goals are attained.
Essential Duties & Responsibilities
Advise Tribe’s Chief Executive Officer, senior management, General Council, Business Committee, Entertainment Authority and other governmental entities, affiliates, committees, boards, and departments on legal issues relative to substantive issues identified in Summary above.
Enforce Tribe’s rights and interests before tribal court, state, federal and administrative judicial forums and any other courts as necessary.
Support multiple stakeholder groups by providing strategic legal counsel and communicating clearly, concisely and professionally to human resources, management and leaders at varying levels on labor relations, wage and hour compliance, workplace accommodations, protected leave, performance management, employee relations, discipline, claims of harassment, discrimination and retaliation, manager and sensitive separations, business reorganizations and compliance with federal, state and tribal labor and employment regulations.
Leverage expertise of internal managing attorneys, staff attorneys, and outside legal counsel to provide legal direction to tribal government and commercial entities on all litigation, employment law and labor related matters.
Provide counsel and guidance on all legal matters involving and impacting San Manuel’s relationship with labor unions.
Own and develop legal strategy and direct junior attorneys and outside counsel on a broad portfolio of litigation and pre-litigation matters in a wide range of practice areas.
Take a hands-on approach to all facets of litigation, including directing the response to subpoenas and discovery requests, drafting and revising legal briefs, interviewing witnesses, preparing witnesses for testimony, and negotiating and drafting settlement agreements.
Manage all aspects of outside counsel relationships, including staffing, litigation strategy, work product, and budgets.
Play an integral role in helping a highly complex and fast paced enterprise adhere to its mission and values by ensuring that San Manuel properly maintain compliance with employment laws, including advising business partners to proactively address and resolve potential disputes while supporting business objectives.
Provide employment law support for M&A, integration and divestiture efforts.
Devise scalable processes and procedures to help support a rapidly growing enterprise.
Deploy legal project management principles and implement key metrics monitoring to drive efficiencies.
Serve on government committees as requested.
Support other areas of the Legal Department as needed to build, mentor and develop legal team members.
The VP Associate General Counsel, Litigation and Employment Law is responsible for managing attorneys and staff attorneys. Carries out supervisory responsibilities in accordance with San Manuel’s policies and applicable laws. Responsibilities include interviewing, hiring and training employees; planning, assigning reviewing and directing work; evaluating and appraising performance; rewarding and disciplining employees; addressing complaints and resolving problems.
Minimum of 10 years broad trial and litigation experience at a leading law firm and/or in-house handling complex commercial litigation, including extensive experience in civil practice, procedure, and contested litigation, alternative dispute resolution and pre-litigation disputes.
Minimum of 10 years of experience in labor and employment law.
Equivalent combination of education and progressive, relevant and direct experience may be considered in lieu of minimum educational/experience requirements indicated.
Extensive working knowledge of state, federal Indian law, and federal law.
Knowledge and experience in all aspects of federal and state administrative agency (e.g., DFEH, EEOC, DOL, etc.) dispute process from start to finish, including investigation, drafting position statements, and attending mediations.
Expert knowledge of US labor and employment laws and legal issues, including but not limited to FEHA, Title VII, ADA, ADEA, NLRA, FMLA, and FLSA compliance.
Demonstrates initiative and accountability to achieve results in order to attain individual and organizational goals.
Demonstrated skills in crafting legal solutions in novel ways, providing practical legal advice and properly balancing risks and business reward.
Strong organizational skills, with an ability to juggle multiple projects at a time in a fast-moving, quickly changing environment, both collaborating as a team and working independently.
Juris Doctorate and active member of the State Bar of California mandatory.
At the discretion of the San Manuel Tribal Gaming Commission, you may be required to obtain and maintain a gaming license.
