This position provides legal counsel, advice and training related to employment law compliance and employment litigation to the various and distinct LVMH Group U.S. companies.
The position reports to the Vice President, Legal Affairs – Employment Law
The successful candidate should demonstrate a solid background and expertise in most substantive employment law areas. He or she should have a practical, solutions-driven counseling ability with an exceptional and upbeat, client-service oriented approach. The candidate should also demonstrate the ability to strategically balance legal and business priorities and build consensus among multiple stakeholders. The position requires working in a fast-paced, multi-tiered corporate structure, so the candidate should be comfortable with multi-tasking and dealing with ambiguity, all while maintaining a definite sense of humor.
At least 5-7 years employment law experience in a law firm or combined as a law firm attorney and as in-house employment counsel.
Expertise as a counselor on accommodations/leaves/disability interaction, employee handbooks, and wage and hour matters is required.
Solid grip on the influx of recent employment law developments related to family leave, sick leave, pay equity, background checks, harassment and others.
Excellent written and analytical ability is expected, with experience drafting position/mediation statements, dispositive motions as well as employment contracts, policies and accommodation letters.
Some experience as a trainer and practical facility with employee benefits is expected.
California law (especially wage and hour) experience is a definite plus.
Labor union, Canadian employment law and experience working in a multi-national group and providing legal guidance to non-U.S. stakeholders are also a plus.
Advise on all aspects of federal, state and local employment law compliance including developing policies and procedures and providing practical solutions to Group brands in order to meet business and best practice requirements while minimizing legal risks including as related to discrimination & harassment, accommodations & leaves, investigations, termination & severance, hiring practices, employee policies and handbooks, wage & hour, performance management, employment related contracts, restrictive covenants, executive compensation and others.
Track and advise on all employment law developments, draft employee handbooks, manage the disability interactive process, and draft employment related agreements, including severance/separation agreements.
The Director will assist in the management of the Group employment-related litigation docket including, arbitrations, administrative actions, demands and legal threats. Represent companies at mediations. Coordinate and assist in management of outside counsel, legal holds, and EPL claims.
Training & Development
The Director will provide training to human resources, managers and employees on various employment law-related subjects including discrimination & harassment, general employment law compliance and updates.
Experience in drafting and developing training modules is a plus.
