Bankruptcy/Creditor Issues, Litigation, Real Estate
Freddie Mac’s Legal Division is seeking a Senior Counsel for the General Litigation Group of its Litigation Department. The position will conduct hands-on litigation and risk management functions and provide legal advice to internal clients. The incumbent will be primarily responsible for counseling the company and representing its interests in bankruptcy and insolvency matters, complex commercial litigation, collection activity, receiverships, and other financial concerns. The hire will also serve as a liaison with legal and business professionals, including IT, for eDiscovery and document preservation and production across a broad range of legal matters.
The responsibilities for this role include:
Conduct and oversee litigation involving the company, its operations and investment portfolios
Represent and appear on behalf of Freddie Mac in bankruptcy/insolvency, receivership, and similar proceedings
Advise internal clients on legal risks relating to the company’s business, particularly those relating to bankruptcy, insolvencies, complex commercial litigation, receiverships, and other financial concerns
Participate in the drafting of complex documents that protect the company’s interests in bankruptcy, insolvency, etc.
Work with IT, business, and legal professionals in eDiscovery and document preservation and production
Respond to third party subpoenas and government requests for information and documents
Understand Freddie Mac’s business, particularly its Single-Family Seller/Servicer Guide (including knowledge of the representations, warranties, covenants and legal remedies) and other contracts, as assigned
Juris Doctor (JD) degree; membership in good standing in a state Bar
4-7 years’ relevant legal experience in-house at a bank or other financial institution with a sophisticated real estate and investment portfolio, or with a top tier law firm
Significant bankruptcy and insolvency counseling and litigation experience
Excellent analytical, strategic, legal research, writing and advocacy skills
Ability to effectively manage numerous issues across multiple areas and set priorities independently, and also to work collaboratively as part of a team and create and maintain strong relationships with colleagues and clients
Strong eDiscovery experience Keys to Success in the Role* Superior oral and written communications skills
Proficiency in supervising eDiscovery
Significant experience bridging the gap between the legal and technical aspects and requirements of document preservation and production (e.g., work at an eDiscovery vendor or as an eDiscovery attorney in-house or at a firm).
