The Corporate IP Counsel will be responsible for developing and maintaining our IP portfolio to meet the goals of the Company’s mission and business. This includes strong integration with R&D, applications, new product development, marketing, operations, regulatory, and quality assurance.
Your responsibilities will include, but are not limited to, the following:
Develop, manage, and continuously evaluate and refine the Company’s global IP strategy to ensure alignment with its strategic objectives
Draft patent applications for new inventions and manage prosecution of pending applications
Develop patent procedures for inventions, products, or unique projects and best practice
Conduct and participate in research meetings and identify internal inventions that may be patentable
Coordinate and collaborate with inventors and the R&D/process teams to generate patent applications
Conduct prior art database searches for patentability and freedom to operate analyses and provide opinions related thereto; analyze patent and scientific papers and documents
Coordinate and manage outside counsel with regards to patent and trademark applications and issues; manage patent annuities
Manage the Company’s global trademark portfolio
Educate top management, inventors, and R&D/process team on IP issues, including patent systems and procedures, trademark processes, and confidential information/trade secret protection
Review, assess, and evaluate purchase of patents or patent licensing from third parties
Review, draft, and negotiate NDAs and other transactions to identify and advise on IP issues
Identify and manage confidential and trade secret information and advise and train employees to protect same
Ensure compliance with all state, local, and Federal laws relating to patent and trademark issues
Maintain and manage database with regards to all patent and trademark procedures and processes
Provide summary updates on a periodic basis for presentation to various groups
EDUCATION / EXPERIENCE REQUIREMENTS:
5-15 years in the food, biotech, or related industry as in-house patent counsel and/or in a nationally recognized law firm
Admission in good standing with the USPTO and any state bar (Colorado preferred)
Degree from an ABA accredited law school
Advanced degree in chemistry (strongly preferred), biology, immunology, oncology, or similar field
Knowledge of U.S. and foreign patent laws and procedures, as well as regulatory matters relevant to the food industry
Proven successful track record of filing and being awarded patents
Strong analytical thinking and patent database searching skills
Strong technical knowledge in food science, microbiology, and chemistry (flavor, fermentation, ingredients) a plus
Strong knowledge of intellectual property rights and protection
Leads employees to work collaboratively with all teams to execute projects that generate IP
Facilitates decision making and displays technical competence in the planning and completion of all documents to achieve IP goals
Key thought leader on IP opportunities and provides all documentation necessary to support all aspects of the life cycle of IP
Work team skills
Experienced in working with multi-functional teams, identifying IP opportunities, creating and overseeing IP development
Critical thinker with a big picture mindset and strong problem-solving skills
Excellent project management and organizational skills, attention to detail, and efficient multitasking
Responds well to changing priorities and quick turnaround projects
Ability to work collaboratively and effectively in a team and adapt to a dynamic work environment
Effective oral and written communicator to present ideas in an understandable, non-technical manner, with internal and external constituencies

Allocates resources between programs and works with team leaders of the programs to set priorities, goals, and timetables for projects to ensure that the Company’s business goals are achieved or exceeded
Demonstrates strategic and tactical thinking skills; must be a change agent to drive projects and challenge conventional wisdom
