The Vice President of IP, Life Sciences is responsible for leading the global Intellectual Property strategy for Thermo Fisher Scientific’s life sciences businesses, with more than $5 B/year in revenue. Leading a worldwide team of more than 25 legal professionals, she/he will be responsible for all aspects of IP and IP operations for Thermo Fisher’s genetic sequencing and biosciences businesses, including people management, IP strategy, patent prosecution, FTO, IP transactions and vendor management.
This role reports to the Chief IP Counsel for Thermo Fisher Scientific and will work closely with other attorneys and key business executives around the world to determine both current and future opportunities to optimize Thermo Fisher Scientific’s IP positioning. Global position with key responsibility for strategy in the US, Europe and Asia; the successful candidate will also influence the company’s China IP strategy.
Lead, manage and guide a high-performing team of in-house IP lawyers and staff, both in the US and in Europe/Asia, to implement Company goals and protect extensive R&D investments across assigned businesses. Sets strategy for patenting efforts, ensures Freedom to Operate and minimizes exposure to third party IP. Supports offensive and defensive IP litigation efforts as needed.
Work with business leaders to set and implement appropriate IP strategies to achieve business objectives, pro-actively identifying emerging risk and opportunity areas and advising senior management on same. Work effectively within the organization to connect resources to address challenges of diverse scope and complexity.
Work with legal and business leadership in setting department culture, development of talent, and budget. Ensure proper staffing level and staff training and development plans are established to support business needs.
Due diligence for M&A.
Explore and evaluate continual process improvement to provide efficient and effective IP generation and risk management. Pro-active in driving improved efficiency of operations. Lead and guide team in implementation of same and structure work in cost effective manner.
Select, evaluate and manage the use of external counsel, vendors and advisers as needed, in coordination with IP department leadership.
Experience and Skills:
Intellectually strong lawyer with at least 15 years’ experience in sophisticated IP legal work, including at least 5 years’ experience in global operating companies with responsibility for leading or managing IP strategy, patent portfolio management and operations, IP counseling and licensing for business involving life sciences, molecular biology, or related area such as pharmaceuticals.
Experienced people leader with at least five years of experience developing and leading high performing teams of attorneys and legal professionals. This leader sets a high bar for performance and develops others in their wake.
Solid experience of working with a business-legal approach and cross-functional teams. Ability to navigate complex and ambiguous environments with intelligent risk taking. Can align and influence through direct and indirect authority, and communicates effectively across teams, functions, and regions.
Solution oriented with innate good judgment, strong but diplomatic presence, robust and enthusiastic self-starter, flexible mindset. Strong negotiating and influencing skills, with an ability to lead and influence at all levels.
Ability to develop practical processes/approaches and to drive solutions to completion, including initiatives to enhance efficiency, quality and productivity. Experience with resource prioritization and developing/managing a budget.
A strong scientific background is required and substantial experience in technology businesses in the life sciences sector; advanced degree preferred.
Exceptional oral and written communications skills. Strong sense of ethics and integrity.
Fluent in spoken and written English (additional language(s) an advantage).
JD from an accredited law school and a member in good standing with the bar. Licensed to practice law in California or eligible for California Registered In-House Counsel Program; registered with the U.S. PTO.
Background or experience with next generation sequencing, single cell analysis, dPCR, flow cytometry, or gene-editing technology.
Experience with IP processes in Europe and China.
Exposure to with brand protection and enforcement; exposure to IP disputes including IPR and patent litigation.
