The Counsel will be responsible for managing and directing a wide variety of commercial, business, and employment litigation matters. This position will be responsible for development and execution, in concert with outside counsel, of case strategy, motions, briefs, appeals, and public messaging of case related issues. This position is also responsible for selection and management of outside counsel, expert witnesses, and trial consultants, and will interact directly with the General Counsel and business leaders. The successful candidate will provide business partners with ongoing advice regarding litigation strategy and tactics, including status of cases, analysis, risk exposure, choice of outside counsel, reputational issues, precedential impact and other considerations.
The Counsel will provide advice and advocacy on a broad range of employment matters, including state and federal employment discrimination and anti-harassment statutes; state and federal wage and hour laws and the FLSA; equal pay; diversity and inclusion; employee discipline and termination; restructuring; whistleblower laws; wrongful discharge claims; recruiting and hiring; employment agreements and policies; employee management; OFCCP and affirmative action compliance; and Human Resource best practices. In strong partnership with Human Resources, the successful candidate will help develop and implement workforce policies and procedures.
The position will be based in Bakersfield, CA at the primary manufacturing site of Bolthouse Farms, and this individual will be a member of the Bolthouse Farms Legal Department. The successful candidate must be able to work effectively with numerous clients in a cross-functional, team-oriented environment.
Juris Doctorate from an ABA accredited law school.
A member in good standing of any state bar (if not already admitted in California, the successful candidate will need to obtain California in-house counsel registration).
At least five years of law firm and/or in-house litigation experience. A concentration in employment, business and commercial litigation. Note that traditional labor & employment experience is key. A combination of law firm and in-house labor and employment experience is a plus, as is experience on behalf of the food industry.
A strong background in litigating and managing complex employment, commercial and business disputes and cases. Experience in handling class actions and food law and food safety matters or other regulatory claims and litigation will be considered a plus.
Excellent analytical and communication skills, both oral and written.
Must be creative, exercise good judgment, and be a quick decision maker and self-starter.
Demonstrated team player with strong interpersonal and organizational skills.
Ability to handle and prioritize multiple projects simultaneously.
Ability to interact effectively and efficiently with business partners on a daily basis and operate with limited supervision.
