This role is a split resource between Legal reporting to the General Counsel and Contracts reporting to the VP, Contracts & Compliance. The role involves handling a mixed caseload ranging from employment claims with varying degrees of complexity, privacy and data protection, and contractor compliance (1099) law. This role requires knowledge on the full range of employment disputes, ability to successfully handle the conduct of claims from the initial assessment stage through supervising outside litigation counsel. The role also requires taking initial instructions, providing clear and accurate legal advice while promptly progressing caseload items in a timely manner.
The primary duty for supporting the Contractor Compliance Services (CCS) team is to ensure the team provides accurate and thorough analyses and recommendations regarding the proper classification of contractors. In addition, this position creates intellectual capital to secure PRO’s position as a thought leader in the Contractor Compliance field. This position also participates in strategic relationship-building with on-site teams (Client Services) and Sales, and provides compliance guidance to internal teams and clients.
The Corporate Counsel is responsible for providing leadership and guidance to the organization on various topics, complying with operational performance standards, providing quality work product in an efficient manner, supporting and defending recommendations for contractor status, as well as providing subject matter expertise in the applicable laws concerning independent contractor compliance.
Keep abreast of specific industry requirements, industry intelligence, and regulatory requirements and help to strategically incorporate any industry changes or trends into the department processes.
Create and maintain intellectual capital, securing PRO’s position as a thought leader in the Contractor Compliance field.
Lead calls with PRO’s client to discuss the Compliance Analysts’ provision of analyses and recommendations regarding the proper classification of suppliers.
Act as point of contact for supplier/W2 recommendation escalations. Communicate as needed with client representatives and PRO Client Services team members in resolving questions, concerns or issues related to supplier/W2 recommendations.
Act as point of contact for requests to support Sales calls/meetings with potential clients.
Provide Contractor Compliance subject matter expertise during Sales and client meetings. Explain “IC issues” and PRO’s solutions.
Participate in client discovery and kickoff meetings, providing Contractor Compliance subject matter expertise.
Research and author Contractor Compliance content for PRO’s Regulatory Newsletter, news alerts, or white papers on various topics.
Prepare and deliver targeted and ongoing Contractor Compliance training to PRO employees and clients.
Review 1099 analyses by assisting in the client presentation analysis and delivery, as needed.
Assist with reviewing and approving various departmental documents such as Standard Operating Procedures (SOPs), manager and contractor questionnaires, and checklists, where needed.
Provide legal and practical advice related to employment issues which may include grievances, discipline, recruitment, dismissal, redundancy, contracts of employment, separation agreements, compensation, benefits, etc.
Assist General Counsel in managing outside counsel for all litigation and corporate matters outside the United States.
Respond to administrative charges and pre-litigation demands.
Provide in-house legal advice on privacy and data protection. Draft complex data protection-related agreements.
Provide guidance and support on various new compliance reporting/data tracking requirements and revisions to internal codes of conduct.
Work with colleagues to build relationships with other departments, as well as with PRO’s client and suppliers.
Uphold PRO’s principles, business controls, ethics, policies and procedures and professional standards.
Attend, participate in, and facilitate as needed, team and department meetings.
Provide on-going support to the department/company, including, but not limited to, leading special projects, reporting, presentations, etc.
Build and sustain trust-based relationships internally and with clients at the appropriate levels while professionally representing the company
Ensure and foster cross-functional collaboration with all internal and external stakeholders (e.g., Client Services, Sales, clients, contractors, suppliers, employees, Technology, and others).
Provide analytical and operational support to all business partners within the PRO team, helping PRO’s business thrive.

Familiarity with contingent workforce industry is a plus.
Juris Doctor from an ABA-approved law school
5+ years’ experience in legal, regulatory, and/or compliance role concerning independent contractor classification issues
Strong knowledge of laws and regulations relating to independent contractor classification
Must be detail oriented, a critical thinker, and a good problem solver
Exceptional written, verbal, and interpersonal communication skills
Demonstrated ability to successfully manage multiple project deadlines while producing quality work product within departmental and organization’s quality standards and strict deadlines.
