Major, Lindsey & Africa (MLA) has been exclusively retained by TopBuild Corporation (Company or TopBuild) to conduct a search for a Counsel – Labor and Employment (Counsel). Overview: Reporting to the Assistant General Counsel, the Counsel – Labor and Employment will deliver results by closely partnering with other TopBuild attorneys, legal assistants and several cross functional teams, e.g. IT, Finance and HR. Specific areas of responsibility will include advice and counsel to internal clients on employee rights and responsibilities regarding discipline, discharge, leave (e.g., ADA, FMLA and PTO), workers compensation and regulatory compliance. The Counsel may also be asked to support the negotiation of collective bargaining agreements, resolve administrative charges of discrimination and retaliation (e.g., Title VII, ADEA, and ADA), respond to federal and state wage and hour investigations, and assist with the development of employment policies and procedures.

Compensation: Competitive salary and benefit package.
Experience: 5+ years of labor and employment practice (in-house or as outside counsel) mandatory, to include government regulatory experience (such as EEOC, OFCCP, DOL). Experience in the construction industry is preferred. Proficiency in Spanish is strongly preferred.
Location: Daytona Beach, Florida (approximately 50 minutes northeast of Orlando).

Bar Admission: Admission to a State Bar of any jurisdiction in the United States and licensed to practice in Florida (or admitted to the Florida Bar within a reasonable time following the commencement of the position).
