At National Spine & Pain Centers (NSPC), our mission is to relieve pain and improve quality of life through personalized, accessible care. We are currently looking for an Associate Counsel, Legal to perform defined functions on behalf of the legal department and provide legal advice and support to senior management, management and employees of a rapidly growing, nationally recognized physician practice management organization as well as its parent, subsidiary and affiliated and/or managed entities.
Working under the guidance of the General Counsel, the role will be responsible for:
Draft, review, structure and negotiate physician/referral source arrangements (to include employment agreements, contracts and leases) and manage review of policies, procedures and resources while working closely with internal stakeholders.
Analyze and provide guidance on operational issues and evaluate, prepare and file regulatory documents in connection with operational matters.
Conduct and/or direct internal investigations in a cost effective manner and respond to governmental inquiries.
Draft, review and negotiate a wide variety of contractual agreements. Provide guidance related to contractual matters and assist in resolution and/or mitigation of contractual disputes.
Provide guidance in the areas of fraud and abuse (False Claims Act, Stark Law and Anti-kickback Statute), HIPAA privacy/security, clinical research and other regulatory matters.
Research, prepare and present educational programs on patient care matters, regulatory guidance and other legal topics.
Monitor and organize critical legislation, regulatory changes and judicial decisions that have the potential to impact the organization.
Serve as a resource to paralegals, contract specialists, other attorneys and/or administrative staff.
All other duties as assigned.
Juris Doctor Degree from an accredited law school located in the United States.
Current license in good standing to practice law in at least one (1) state.
Demonstrated experience in analyzing, drafting and negotiating physician/referral source arrangements, responding to governmental inquiries and providing legal guidance in the areas of patient care, regulatory compliance and fraud and abuse.
At minimum of five (5) years of progressively responsible experience representing clients in the health care industry.
Law firm experience preferred.
Must possess strong legal research, analytical and contract drafting skills.
The ability to independently manage matters and prioritize to meet competing deadlines.
Must know when to appropriately escalate issues to the General Counsel as necessary.
Be able to work collaboratively and effectively in a fast-paced environment with shifting deadlines and priorities.
Ability to work well under pressure and maintain composure without compromising quality of work.
Possess highly effective verbal and written communication skills to successfully interact with senior leadership, management, physicians, regulators and outside counsel.
Skilled in the use of Westlaw or Lexis/Nexis and Microsoft Office Suite.
Ability to maintain confidentiality of information at all times.
Flexibility to travel, as needed.
A satisfactory background check inclusive of criminal records, employment references, education, social security and OIG exclusions.
