Provides day-to-day oversight of ECMC’s national student loan litigation portfolio, coordinating the efforts of ECMC’s in-house and outside counsel pursuant to strategic direction of the Director of Litigation. Oversees other litigation and pre-litigation disputes as assigned involving ECMC Group companies. Advises business partners on risk management for existing and proposed business policies and practices.
ESSENTIAL DUTIES AND RESPONSIBILITIES:
Under supervision of and consultation with Director of Litigation:
Maintain current in-depth knowledge with respect to specialized areas of law as assigned, including, but not limited to, bankruptcy, collections, consumer rights, higher education and student issues
Maintain in-depth knowledge of student loan industry regulations
Manage all aspects of assigned litigation, including research, discovery, pretrial, negotiations, trial and/or the appellate process
Appear as a representative of and/or counsel for ECMC at mediations, depositions, trials and appellate oral arguments
Formulate legal strategy and educate / oversee outside counsel
Identify national industry trends and emerging legal precedents to develop and assess potential issues for litigation and/or appellate review
Budget, review, and approve outside counsel expenditures, implement and maintain expense controls
Draft and/or provide oversight / review of all assigned appellate briefs and other substantive pleadings or memoranda
Review, research and advise corporate clients regarding legal issues and risk associated with current or proposed business policies and practices as assigned
Comply with all ECMC Group Policies

EDUCATION and EXPERIENCE
Juris Doctor (J.D.) from an accredited law school
Minnesota bar license
1+ years of litigation or litigation management experience - bankruptcy and/or collections related legal experience preferred
KNOWLEDGE, SKILLS and ABILITIES
Strong research and writing skills
Ability to work as a trusted member of a legal team
Requires the ability to analyze problems, set objectives, and develop effective solutions
Solid interpersonal and advanced communication skills
Basic to intermediate knowledge and skills working in a computer based office suite environment; Microsoft Windows or Mac Office
Ability to manage conflicting priorities and handle multiple tasks/projects concurrently
Ability to effectively organize, plan, control and prioritize work/projects. Ability to regularly communicate progress to appropriate stake holders. Efficiently manages resources and understands work/project scope, key players, urgency, inherent risks and business benefits.
Displays and promotes high standards of ethical conduct and behaviors consistent with organizational and government standards
Ability to consistently carry out job responsibilities
Ability to anticipate, understand and manage customer expectations and consistent delivery of services. Clearly and effectively conveys information
