Under the direction of the Chief Legal Counsel and the ECHD Board of Directors, the Staff Counsel is responsible for providing in-house legal counsel to the organization on matters including but not limited to, governmental affairs, real estate, contracts, and general operations and regulatory matters.
Responsible to:Chief Legal Counsel
Workers Supervised: Legal Secretary
Interrelationships: Frequent contact with Senior Management,
ECHD Board of Directors, members of the Medical Staff, and the general public.
Responsibilities and Authorities:
Performs other duties as assigned by the Chief Legal Counsel and ECHD Board of Directors.
As patient care and/or Hospital need dictates, both the assigned shift and work station may be changed by the department.
Participates in and promotes the “I CARE” service philosophy of Integrity, Customer Centered, Accountability, Respect and Excellence.
Performs essential job functions with or without reasonable accommodations.
Prepares and facilitates contracts initiated by the organization.
Ensures that internal and external contracts entered into by the hospital are legally sound in accordance with federal and state laws.
Reviews legal documents prepared internally and externally.
Keeps abreast and informs the Chief Legal Counsel of issues, changes or cases that may impact the business of MCHS.
Brings legal issues and concerns to the attention of Chief Legal Counsel, and other senior leaders of administration, as necessary.
Assists in the preparation of ECHD Board materials and attends ECHD Board of Director Meetings, and participates in ECHD Board matters as directed by the Chief Legal Officer.
Acts as a resource on the interpretation of existing or proposed local, state, or federal laws and regulations that may impact the business of MCHS.
Assists the Chief Legal Officer in the management of outside legal counsel regarding specific matters, such as litigation.
Provides legal guidance to the organization regarding requests for documents under the Texas open records law.
Performance Factors Used to Evaluate Employee:
Works cooperatively with other management team members to insure the
Department is integrated into the Hospital. Employee works cooperatively within the organization to assist in Hospital wide efforts.
Consistently enforces and abides by Hospital and department policies and procedures.
Promotes a culture of safety.
Maintains compliance with The Joint Commission standards and other applicable laws and regulations.
Follows established reporting protocol to keep Administration informed in a timely manner of significant events and departmental concerns.
Provides sound legal advice regarding legal issues that arise.
Provides high level sound counsel and advice concerning compliance with applicable federal and state statutes and regulations.
Provides appropriate legal counsel regarding monitoring and
resolving disputes that may lead to litigation. Assists, as needed, with the system’s response to external requests for information, reporting complaints, or citations from external governmental or non-governmental organizations.
Responsible for providing legal representation, advice, counsel and opinions in all areas of law affecting MCHS, including but not limited to, governmental affairs, real estate, contracts and operational issues as necessary.
Juris Doctor Degree.
Training and Experience:
Minimum of three (3) to nine (9) years experienced and licensed to practice law in the state of Texas, or another state jurisdiction in the United States. Experience in healthcare law preferred. May consider a new graduate
Additional Salary Information: The salary is determined by years of experience and a new grad may be less than the starting wage
