The Associate General Counsel, Employment and Benefits, is responsible for ensuring the company’s compliance with employment laws, and leads a team of employment, immigration and benefits lawyers responsible for counseling management, responding to administrative charges, and managing litigation matters.
Principal Duties and Responsibilities
Designs compliance plans, and often serves as project manager to ensure implementation of those plans.
Researches and advises on employment law issues including wage and hour; Title VII; ADA; FMLA; state and local laws, including leave laws; FCRA, and OFCCP.
Assists the business with developing legally compliant, yet practical solutions to employment-related issues.
Provides guidance on, and often drafts, employment-related policies, programs and initiatives.
Leads team of employment, immigration and benefits lawyers who are responsible for responding to administrative charges, providing legal advice to business leaders, and managing litigation.
Develops and conducts training programs for leaders.
Prepares memoranda and reports relating to legal issues and recommendations.
Promptly responds to urgent situations and leadership both during and outside regularly scheduled working hours.
Stays current with employment laws, trends and practices, and updates advice to management.
Manages and assists with strategy on class action employment-related lawsuits.
Retains outside counsel for litigation matters.
Juris Doctor (J.D.), active member in good standing in at least one State bar
Minimum eight (8) years of experience in employment law in private practice and/or in-house.
Minimum 2 years in managing lawyers and legal professionals
Strong command of labor laws, regulations, and best practices, and a genuine interest in the subject that fosters continuous self-initiated improvement and on-going subject matter expertise
Extensive litigation experience; experience in handling or advising on grievance/administrative proceedings and unions subject to Railway Labor Act a plus
Experience with collective bargaining agreements and working with unionized workforce
If not currently residing in the Dallas area, willingness to relocate
Experience working directly with union leadership preferred
Excellent analytical skills and the ability to render persuasive, diplomatic, practical, creative, and at all times legally compliant advice in a timely fashion
Excellent business acumen with the judgment and ability to advise on labor law matters within the business context
Excellent written and oral communication skills, especially of complex issues, and attention to detail and accuracy
Self-starter with executive presence and the ability to manage multiple projects effectively and produce excellent results.
Ability to organize and prioritize tasks, and handle high-pressure situations and short deadlines
Demonstrated skill and experience in litigation risk assessment and risk avoidance/reduction strategies
Ability and patience to independently develop relationships across the organization
A confident and collegial team player that can work in a highly collaborative environment and influence decisions while not having direct authority
Thoughtful and creative problem solver
Strength to take and sustain difficult positions without alienating others
Ability to thrive in a fast paced, fluid environment
