The Employment Attorney is an in-house position, with a flexible schedule, providing practical and business-focused employment law advice and counsel, taking into account multiple stakeholder perspectives. As the primary counselor to HR and General Management teams across eight separate FEINs, the Employment Attorney will ensure compliance while reinforcing a strong employee experience. This will include legal services such as advice and counsel on the full range of employment issues (employee discipline, policies, leaves and accommodations, investigations, separation agreements), optimizing litigation results (agency, individual and class action), and provide employment law training/skills development and projects.
Work with Corporate HR team to evaluate current employment practices, policies, and processes to assess and execute priorities, and ensure compliance.
Partner with HR team to investigate and respond to claims, demand letters, administrative complaints, audits, and other employment-related inquiries.
Provide advice and counseling on a broad spectrum of employment law issues, including: recruiting, employee relations, performance management, leaves of absence and accommodations, wage and hour, internal investigations, compensation and benefits, privacy, and contingent workforce issues.
Assist in developing and conducting best-in-class training on employment-related matters and programs.
Coordinate response to charges from state and federal agencies, including subpoenas and similar requests for employment-related records.
Assist in managing outside counsel on labor and employment matters, and manage employment litigation as needed.
Keep general managers and HR informed of significant labor and employment trends and decisions, legislation and rulings.
Assist with employment-related projects, including the review of internal procedures, new policies, and benefits.
Conduct audits, classification reviews, and support other compliance efforts.
At least 7 years of experience at a major law firm, with prior in-house experience preferred. Union and Federal Contractor experience a plus;
In-depth knowledge of federal and state employment laws and regulations including NLRA, SCA, FLSA, Title VII, Americans with Disabilities Act, Family Medical Leave Act, EEO laws, wage and hour and other federal and local laws affecting the employer-employee relationship and federal and state prevailing wage laws;
Experience addressing and resolving complex and sensitive employee relations and compliance issues;
Ability to independently determine and develop solutions to complex legal issues that are practical, clearly and timely communicated, and consistent with business objectives;
Excellent written and oral communication skills, legal research skills, and interpersonal skills;
Ability to evaluate risk in light of business and practical considerations and make clear recommendations;
A J.D. from an accredited law school with strong academic credentials;
Licensed and in good standing to practice law within California.
