AkzoNobel Specialty Chemicals- has an outstanding opportunity for an HSERA (Health, Safety and Environmental and Regulatory Affairs) Legal Counsel. The HSERA Legal Counsel is a highly motivated, qualified legal professional with substantial knowledge of health, safety, environmental and product regulatory laws and regulations, the assigned business and the legal environment it operates in. S/he handles matters individually (end-results are reviewed by a senior colleague at key decision points) with significant opportunity and exposure to the Company, and s/he interacts with (senior) business leadership. S/he responds to request for legal advice and analysis; offers proactive advice regularly and signals prospective legal risks.
The HSERA Legal Counsel plays an essential role to safeguard the strategic objectives of the assigned business and to ensure a limited (legal) risk exposure within a broad scope of HSERA legal topics. S/he needs to be flexible in providing support and taking on (new) responsibilities amongst a committed group of legal colleagues in order to respond properly to the changing needs of the business.
Provide legal advice and services to the Company’s businesses and functions in North America (and in South America, on an as needed basis) on a wide range of health, safety, environmental and product regulatory matters, including but not limited to:
o Providing legal advice and services with respect to health, safety, environmental and product regulatory aspects of commercial transactions
o Providing legal advice and services with respect to health, safety, environmental and product regulatory aspects of manufacturing and distribution, including but not limited to operating permits, spill/release and emissions reporting, OSHA compliance, product registration (TSCA, FIFRA, etc.), packaging and transportation requirements, labelling, etc.
o Providing legal advice and services to the Company’s Legacy Asset Management Group on environmental matters, including but not limited to RCRA, CERCLA and natural resource damages
o Providing legal advice and services with respect to health, safety, environmental and product regulatory aspects of divestments and acquisitions, including but not limited to participation in due diligence, assessing and providing opinions on potential liabilities and drafting and negotiating relevant provisions in contracts
Manage outside counsel
Conduct/oversee internal investigations with respect to health, safety, environmental and product regulatory matters, including but not limited to workplace injuries, spills/releases and potential violations of law
Provide strategic input and manage claims and disputes concerning health, safety, environmental and product regulatory matters
Monitor, communicate to interested personnel and act on new, revised and amended statutes, regulations and judicial decisions relating to health, safety, environmental and product regulatory matters
Contribute to the development and implementation of health, safety, environmental and product regulatory standards, systems, procedures and training
Member of the Global HSEPR Practice Group
Willingness to travel as required, up to 15% domestic and maybe internationally
J.D. degree from an accredited law school with admission to the Illinois bar or at least one other U.S. state bar (and eligible to be admitted in Illinois for in-house practice)
7+ years relevant experience at an (inter)national law firm or in an in-house legal department
Excellent knowledge of health, safety, environmental and product regulatory laws and regulations, including without limitation OSHA, TSCA, RCRA, CERCLA, the Clean Air Act and the Clean Water Act
Solid dispute resolution and negotiation skills
Ability to effectively interact with business management, business and functional personnel, internal and external counsel, internal and external technical consultants, government agencies and private parties in a wide range of settings
Top level analytical, counselling, communication and interpersonal skills
Sound legal and ethical judgment
Ability to work as part of a team
Technical background (especially environmental and/or chemical) is a plus
