Position will provide legal counsel and advice to Human Resources and other internal client organizations of the bank with respect to employment related matters. Oversees all employment related litigation and arbitration involving current and former Bank colleagues and/or Bank employment practices. Expertise in employment litigation and other employment law subject matters described below is essential, as is the ability to work and communicate effectively with management and staff at multiple levels. The successful applicant will be expected to help analyze and address legal risks associated with a full range of employee matters and related litigation and arbitration, EEO compliance, hiring practices, compensation and wage and hour practices, disability and leave management, equal pay obligations, workers compensation, affirmative action, and intellectual property issues; provide business transaction support; assist in policy design and drafting; provide guidance on internal investigations; provide advice re implementation of overall business strategy; and maintain an up to date working knowledge of key state and local laws legislation and regulation affecting employers in the jurisdictions where the Bank operates.
A JD and admission to the California State Bar
Minimum 15 years of experience at a major law firm (employment and/or labor law practice), or in-house legal department
Minimum 15 years of experience with employment litigation and/or provision of proactive advice and counsel on employment law matters.
Exceptional written communication skills
Provide legal counsel to Bank’s key Human Resources Division colleagues as well as managers assigned to other Bank divisions, affiliates and subsidiaries on any employment and/or benefits related matters.
Oversee and manage labor and employment-related Bank litigation and matters before administrative agencies such as the EEOC, DFEH, DLSE, EDD and NLRB.
Select and manage outside counsel representation of the Bank in litigation, arbitration, and/or regulatory proceedings in both California and other state and federal jurisdictions.
Oversee and/or direct privileged audits of Bank and or affiliate employment practices.
Provide guidance on internal investigations involving potential violations of Bank policy.
Advise, review, and prepare bank policies, employment contracts, settlement agreements, and business contracts associated with employment related services retained by the Bank.
Provide legal counsel and support, including but not limited to the following specific areas:
Hiring practices (including issues related to recruiting practices, FCRA compliance, OFCCP compliance, contingent workers, I-9 processing and compliance, service contract reviews, and offer letters)
Employee Relations (including separations, RIFs, investigations of and claims for discrimination, harassment and retaliation, investigation as and reports of colleague misconduct, etc.)
Compensation Practices (issues relating to OT exemptions, regular rate compliance, wage theft protection, meal and rest breaks, incentive compensation plans, fair pay act compliance, alternative work schedules et al.)
Leaves of Absence and Disability Management (including providing reasonable accommodations, sick leave laws, vacation policies and practices, FMLA/CFRA/PDLL compliance, and special leave benefit programs.

Work collaboratively with the Chief Human Resources Officer, the HR Business Partner Manager team, HR subject matter experts and other senior executives and managers in ensuring Bank compliance with all applicable federal, state and local employment and labor related laws, regulations, and ordinances.
Skills And Knowledge
Well-versed in California and federal laws and regulations governing employment including but not limited to the California Labor Code, Fair Pay Act, FEHA, Wage Orders, ICRA, FCRA, CFRA/FMLA, FLSA Title VII, ADEA, ADA, and OWBPA. Working knowledge of the NLRA and ERISA a plus. Familiarity with similar laws in New York also a plus.
Experience with and knowledge of legal principles applicable to employment contracts and settlement agreements, including releases and protection of intellectual property and indemnification.
Management of outside employment litigation counsel, and preferred experience taking and defending depositions, motions to compel arbitration, routine discovery, expert witness selection and discovery, examination and cross examination of witnesses at trial or arbitration.
Experience and excellence in analyzing, interpreting and communicating legal strategies and requirements with clients, and in translating complex legal requirements into written materials and oral presentations, and in effectively advising clients on best practices and risk management as well as in developing of modifying compliance policies, procedures and training programs.
Experience working with administrative agencies and inquiries (e.g. DFEH, EEOC, DLSE). Experience with WCAB and UIAB a plus.
Proven leadership with initiative and problem solving abilities.
Ability to effectively manage and balance multiple and competing priorities for timely completion of requests for legal services.
Excellent interpersonal, verbal and written communication skills.
Strong presentation and documentation skills.
