The Assistant General Counsel will be responsible for working with the Human Resources (HR) department to manage the vast majority of labor and employment related matters for the Company. The Assistant General Counsel will represent PGE in a broad variety of areas related to human resource matters, including counseling and advice to HR professionals and management, management of outside counsel, and representing PGE before Federal and State regulatory authorities (the United States Equal Employment Opportunity Commission (EEOC) and Oregon Bureau of Labor and Industries (BOLI)). Significant practice areas are employment law (including, but not limited to, workplace discrimination, harassment, accommodation (ADA), leaves of absence, and wage and hour issues), labor relations, immigration, and health and safety (including OSHA and Workers Compensation matters).
Responsibilities include working closely with PGE’s Human Resources department on significant employee related legal, business, and communications issues and defending the company’s interests before regulatory agencies, as well as managing outside counsel in a variety of federal and state dispute resolution situations. The attorney in this role will provide support throughout the business as needed as well as advising internal stakeholders and working collaboratively with legal team members. The Assistant General Counsel will contribute to the protection of Portland General Electric Company’s legal interests, compliance with applicable laws and regulations, and facilitate the achievement of corporate objectives by providing timely, high-quality, thorough and cost-effective counsel concerning complex legal issues.
Provide in-house legal counsel on employment and labor matters to Company’s HR professionals and management. This responsibility includes legal research and oral and written advice on the Company’s rights and obligations on a broad range of employment and labor law issues, which may include, but are not limited to, terminations and discipline, leaves of absence and reasonable accommodation, fitness for duty, wage and hour considerations, workplace harassment and discrimination investigations, whistleblower treatment, retaliation claims, workers’ compensation, unemployment and other state agency claims, labor relations, employment and separation agreements and policy related issues, and employment-related litigation, grievances, arbitrations and mediations.
Participate and influence decision-making process with internal clients and stakeholders relating to employment and labor matters and employee communications.
Represent the Company before Federal and State regulatory agencies.
Represent the Company in negotiations with employees, unions and other stakeholders, including settlements of disputed matters on behalf of the Company.
Stay current and advise HR professionals and management regarding new legal developments, trends, and challenges.
Collaborate with HR and advise on investigations of employee conduct.
Review and draft Company employment-related policies and manuals and employee communications.
Identify and help develop appropriate strategies to ensure Company-wide compliance with applicable federal, state, and local laws and risk mitigation strategies in connection with employment and labor matters, including training of managers and employees.
Draft, review, and negotiate agreements for the HR department and other Company departments as needed.
Provide labor law advice and counsel and/or manage outside labor counsel efforts.
Manage outside counsel work on Workers Compensation and immigration matters.
Develop templates and processes.
Officers and company managers - interpret legal rulings, provide opinions and advice.
Governmental agencies – represent and advocate for PGE interests and solicit assistance/information.
Counterparties and third parties - represent and advocate for PGE interests.
PGE employees – provide advice and guidance, and training.
Board of Directors and committee members – provide updates on legal actions, challenges and risks, as needed.
Outside counsel – manage, seek advice from and support outside counsel in litigation, mediation and arbitration.
Travel: Candidate may be required to travel within the PGE service area, to its generation facilities and to state and federal regulatory offices. Occasional overnight stays may be required. Expected travel is estimated at no more than 10% of work time.
Ideally 10-15 years related experience, but a minimum of 7 years related experience.
Effective, extensive and sophisticated experience in employment and labor matters, including the areas described under Responsibilities above Successful representation of clients before EEOC, BOLI or in court in complex litigation.
Commensurate law firm, in-house or government agency experience.
Active member in good standing of the Oregon State Bar, or ability to acquire the same.
