The successful candidate will possess 10+ years of experience in employment and benefits law and litigation, and ideally 5+ years of expertise advising and either working closely with or managing an HR team. S/he must have deep familiarity with California and Federal employment law, including its application in the litigation context. S/he will be responsible for supervising outside litigation counsel, including on non-employment and non-labor matters. S/he will have experience with collective bargaining and other union matters, as the company has collective bargaining units in three of its several several northern California locations.
On the legal side, this executive will provide day-to-day advice and counseling on a diverse array of employment issues, handle all compliance and training and oversee the HR team on any and all employment issues that arise from company operations.
Other primary legal functions shall include:
Drafting and implementation of employee-related policies and procedures
Negotiation and drafting of employment-related agreements and documents
Assisting as needed with Collective Bargaining Agreement negotiation, drafting, and implementation
Maintaining open and frequent lines of communication with the CEO, COO, and other senior management on relevant legal issues
Providing similar legal support on a more limited basis to a smaller affiliate of the company in a different distribution industry and location
On the HR side, as the leader of the HR function, the successful attorney will also be responsible supervising the HR team and developing and managing HR team strategies and operations to ensure business objectives are met. As part of this role, the leadership team will be looking for this executive to assess the current HR function and provide recommendations on any reorganization of the reporting structure within HR and related issues. S/he will be the the ultimate “go to” person for human resource matters.
Other primary HR functions shall include:
Plan, develop, organize, implement, direct, and evaluate the company's HR function and performance to support achievement of overall business objectives
Oversee establishing/revising, communicating, and implementing HR policies and procedures
Lead, coach, guide, counsel, train, and mentor HR team on employment issues such as policy and procedure interpretation/application, dispute resolution, investigations, employee discipline, and leaves of absence
Maintain consistency – legal and non-legal – among HR policies, procedures, and practices across the company’s entire footprint (currently nine locations)
Manage budget and other financial measures of the HR Department
Ensure attorney-client privilege of communications maintained where necessary or appropriate
Maintain open and frequent lines of communication with the CEO, COO, and other senior management on HR issues
For all phases of the position this attorney must have strong analytical, oral, and written skills and strong planning, project leadership, and organizational skills. S/he must have a demonstrated success in driving employment law and HR initiatives and programs in a rapidly developing and changing environment. S/he must be detail-oriented and a proactive self-starter with the ability to work independently in an office separate from the General Counsel and others in the law department. Good judgment (especially in the midst of a crisis), the ability to present and resolve sensitive issues with senior management, and a commitment to providing exceptional client service and satisfaction are essential to the position. All candidates must have excellent academic and prior practice credentials and must be admitted to practice law in California. The company is willing to relocate candidates from the Bay Area to Sacramento.
