Managing Counsel - Plano. Our client, a finance and insurance brand for one of the world's most admired brands, is in need of a Managing Counsel - Servicing to work with the consumer finance products team in support of providing financial services servicing support. This role will consist of:
• Reviewing and analyzing business practices and proposals for compliance with federal and 50 state laws regarding the following areas of law and products: servicing, collections (state and federal), repossessions, bankruptcy, remarketing, consumer lending products, consumer credit, credit reporting, fair lending and Equal Credit Opportunity Act, pricing, payment channels including electronic, advertising, privacy, information security, social media, digital delivery of products and services, antitrust, OFAC and money laundering, credit cards, deposit accounts, consumer mortgage lending products and general banking laws such as affiliate transaction restrictions; • Representing the Legal Department in cross-functional teams and task forces formed to implement new business or legal initiatives; • Assisting with CFPB and other regulatory preparedness; and • Communicating legal opinions and recommendations simply, effectively, persuasively and professionally in writing, meetings and telephone calls.
Qualified candidates must have: • At least 10 years of experience providing providing operations, legal and regulatory advice to lenders (preferably some portion of that time advising captive or other automotive finance lenders or companies); • Compliance mindset; • Experience in financial services and collections; and • In-house experience
