In support of its growth strategy, Advanced Bionics (“AB” or “the Company”) seeks to appoint an experienced, dynamic and commercially-oriented Senior Legal Counsel, US and Canada (“Senior Legal Counsel”). This individual will play a key role as a valued global business partner and contributor to the overall success of the business.
This is an outstanding and exciting opportunity for a broad-based attorney who combines exceptional legal skills and knowledge of the medical device sector with strong commercial capabilities to help shape AB’s development in the US and Canada. These key markets represent a substantial portion of the Company’s revenues worldwide. The Senior Legal Counsel will be a proactive and collaborative business partner and be able to work with and influence key business leaders.
The Senior Legal Counsel will report to the General Counsel of the Company, who is based outside the US, and on a dotted line to the Vice President of Finance, based in Southern California. The role will be supported by an Administrative Assistant and Contracts Administrator.
The Senior Legal Counsel provides legal support to all of AB’s operations in the US and Canada, with a focus on the overall sales and marketing efforts of the Company and the partnership with the regional VP of Sales, also including FDA, regulatory and reimbursement matters for Class 3 medical devices. In this role, the Senior Legal Counsel will work collaboratively with divisional functional and business partners on new as well as ongoing commercial strategies, identifying and analyzing legal risks and proposing appropriate actions to secure compliance with relevant rules, FDA and other regulations and policies.
Additional responsibilities include:
Reviewing product advertising materials for compliance with corporate policies and applicable laws;
Partnering with the Compliance Manager to establish and maintain best practices and policies for interactions with healthcare professionals and patients and ensuring compliance with relevant laws;
Providing regular trainings and updates on legal and compliance topics to diverse groups within the company;
Assessing current company policies versus legal requirements, industry association codes and industry best practices and cross-functionally coordinating changes and improvements where necessary, also eliminating redundant policies where reasonable;
Drafting, negotiating and reviewing agreements relevant to the Company’s operations, including but not limited to agreements with vendors, customers, health insurance plan providers as well as healthcare professionals, clinics and medical institutions;
Assisting the responsible members of the legal team where necessary and required in employment law and litigation matters;
Collaborating with other members of the parent company’s legal team, based in the US as well as in Europe, on an ongoing basis;
Managing outside counsel on select matters to ensure specified legal outcomes are delivered on time, within budget and at the required quality; and
Collaboratively leading, directing and coaching members of the Legal and Compliance team as the case may be, ensuring capabilities are aligned to the Company’s objectives.
PROFESSIONAL EXPERIENCE AND QUALIFICATIONS
The Senior Legal Counsel will have a minimum of five years of legal experience that preferably includes in-house experience in the medical device or broader life sciences industry; good working knowledge of US federal and state laws applicable to the commercialization of medical devices or other regulated products such as pharmaceuticals; strong communication skills, both verbally and in writing; and experience working for an international company and across a matrixed organization.
