BD’s Life Sciences Segment has an opening for an experienced biotech intellectual property counsel for its Biosciences and Genomics Solutions businesses located in San Jose and Menlo Park, California, respectively. The position may be based in either location provided that significant time is spent in Menlo Park. This is a highly visible, key role within BD’s dynamic cell analysis and genomics businesses. The successful candidate will have primary intellectual property counseling responsibility for, and be fully integrated into, the Research and Development and commercial activities for these business units. This responsibility includes driving legal strategy and designing legal support processes for achieving strategic business goals. Responsibilities include: • Managing internal and external resources for the preparation, filing, prosecution, strategy and management of U.S. and international patent and trade secret dockets including accountability for managing the legal expense budget for specific matters and/or projects; • Performing patentability, freedom to operate, infringement, validity and product clearance analyses as needed for research and commercial activities and recommending actions and alternatives based on the risk profile and objectives of the business; • Monitoring/analyzing competitive intellectual property and product offerings for advising the innovation community and business partners about IP strategies; • Collaborating with commercial and M&A counsel for diligence activities as well as optimizing IP clauses for research contracts, license agreements and other business agreements; and • Supporting an IP aware culture by conducting internal education seminars.
Qualifications: • J.D. degree; • M.S. or Ph.D. and strong background in microbiology, biochemistry, molecular biology, or cellular biology; • 6+ years of experience and general IP knowledge particularly in patent prosecution and advising business clients; • Experience working globally to coordinate filing and prosecution of international patent applications • Ability to efficiently communicate to outside counsel legal positions and impact of these positions on business strategies; • Experience developing and implementing IP strategies, conducting freedom to-operate analyses, and IP portfolio analyses; • Ability to work independently to identify material information and proactively resolve issues with periodic management oversight; • Strong organizational skills, keen attention to detail, and ability to prioritize projects; • Demonstrated ability to establish thorough understanding of different IP positions and analyses; • A forward-thinker who anticipates needs and develops alternative plans to support business needs; • High personal integrity and ethics; and • Well-reasoned, accurate and persuasive speaking and writing skills (writing samples may be submitted). The following skill sets are preferred by the Legal function: • Ph.D. in cellular biology, biochemistry, protein sciences, enzymology, microbiology, or other like disciplines; • Familiarity with IP issues raised in software licenses; • Interest in, or experience with, managing others; and • In-house legal experience.
