(NYSE MKT: VISI), a Fortune 1000 staffing company providing full spectrum contingent employee recruitment, professional search services and managed service programs, seeks experienced employment counsel with high energy, high output and a positive attitude for the position of Vice-President and Assistant General Counsel, Employment, reporting to the SVP, General Counsel and Corporate Secretary. The position is based in Orange, CA.
Serve as dedicated legal advisor to the Human Resources department
Develop business-focused solutions and independently handle employment-related legal issues that arise pertaining to the company’s in house employees and its contingent workforce (including FLSA, worker classification, discrimination, harassment and retaliation claims, employee hiring, discipline and termination, disability accommodation, wage and hour, statutory leave laws, health & welfare benefits, retirement plans, ERISA-related concerns, and other similar matters)
Manage and execute all aspects of employment litigation in state and federal courts, arbitrations, mediations, cases before administrative agencies, attend and/or participate in hearings, prepare and handle discovery, trial or arbitration, directly as counsel of record or indirectly with outside counsel
Draft, develop and/or advise on employment practices, procedures, policies and guidelines
Draft, recommend and revise as necessary form employment agreements, employee handbooks, employment policies, severance and settlement agreements, benefits contract renewals, confidentiality agreements, non-competition and restrictive covenant agreements, and other similar or related documents
Advise on preventative action and develop/conduct trainings pertaining to discrimination claims, disability and access accommodation, drug and alcohol testing, OSHA, reductions in force, workplace violence, privacy practices, etc. for the company’s management, in-house and field employees
Support internal investigations and audits
Direct and oversee outside counsel handling employment litigation, review invoices and manage legal fees and budget
Responsible for keeping General Counsel informed of any major or significant employment matter which may affect the company, including but not limited to department or company staffing issues, threatened claims or lawsuits, whistleblower claims, and other similar or related matters
Identify areas in need of change and recommend new policies or procedures to General Counsel, draft materials, forms and instructional guidelines in support thereof
Supervise legal department support staff
Perform specific projects as assigned from time to time by the General Counsel or Chief Human Resources Officer.
Knowledge, Skills and Ability Requirements:
Strong knowledge of state and federal employment and labor laws; knowledge of staffing industry a plus
Excellent and effective written communication and drafting skills, including in a manner which may be easily understood by all members of the company, with responsibility for drafting of all types of documents
Strong and persuasive verbal communication skills required; must be poised, professional and confident in dealings with management, employees and counterparties
Must be self-motivated, organized, detail-oriented and capable of multi-tasking with superior follow-up capabilities
Must exercise sound judgment and work well independently in a fast-paced environment
Ability and desire to take ownership of employment law sphere
Ability to lift a minimum of 25 pounds, function easily within a general office environment, including the use of office equipment and accessibility to four drawer lateral filing and ability and willingness to travel minimally, as necessary
Computer proficiency in multiple Microsoft applications and eDiscovery tools.
Education and Experience:
JD degree from a nationally-recognized law school, with a strong academic record required
12+ years combined employment law experience in both counseling HR departments on employment law matters and employment litigation is required, with initial training at a top tier law firm preferred
Admitted to practice and in good-standing in California.
