The Company’s mission is to be a game changer in the space industry by being the first truly viable commercial operation to apply mass production techniques to satellite manufacturing.
As part of its day-to-day operations, the Company is constantly developing and acquiring rights to IP, and is importing and exporting significant amounts of data and goods.
This position has a dual role: to act as the first member of the legal team to focus exclusively on IP and to be the US Export Control Officer.
This is a new position, neither role has been filled previously in the Company.
As IP Counsel, you are the primary point of responsibility for managing all of the Company’s IP rights.
As the United States Export Control Officer you are the primary point of responsibility for ensuring that the Company complies with US export control laws and regulations.
This position is based in Florida – Cape Canaveral area.
Primary point of responsibility for management of IP rights, including maintenance of Company database.
Negotiate and draft license agreements.
Manage patent and other filings.
Work closely with deal teams to ensure that all IP rights are properly documented and secured in transactions with vendors and customers.
Work closely with the operational, program and engineering teams to avoid infringement, including by developing appropriate proactive protocols.
US Export Control Officer:
In collaboration with the European Export Control Officer, manage and monitor the implementation of export control and regulatory policies.
In collaboration with the European Export Control Officer, define and enforce export control processes in compliance with all applicable regulations (French and US mainly) to enable and optimize business, manage risk and protect the Company from export control violations and their consequences.
Serve as the US resource for the operational, program and engineering teams to advise on individual exchanges of data and goods and ensuring compliance.
Procure and manage export control licenses (TAA, DSP5, EAR licences, STA, European Dual Use licenses, in particular).
Review and write out the Export Control clauses in business contracts.
Identify, monitor, and mitigate compliance risks.
Lead and create export compliance awareness across the Company.
Direct report to General Counsel.
Dotted-line reporting to Program Director and Chief Technical Officer.
At least 5 years’ relevant experience, including both:
Experience as a practicing US IP attorney
Experience in an export compliance role, including proven expertise and knowledge of US export control regulations (other export control regulations, including Europe, would be a plus).
Ability to stay up-to-date and maintain fluency with US export control regulations.
Technical fluency and experience; engineering/science undergraduate degree preferred.
Be flexible and reactive, with the capacity to handle a variety of time sensitive matters simultaneously by applying an organized and methodical approach.
Manage the day-to-day work in an efficient way by offering pragmatic advice, focused on finding solutions.
Coordinate and align input across internal multi-functional teams.
Communicate issues/problems in a clear and concise manner.
Be team orientated and ready to work in an international, fast-moving and complex/technical environment.
Be willing to embrace the challenges and opportunities that come with working for a start up that is developing new technology.
Demonstrate a positive attitude and be willing to build relationships within the department and across the organization.
