Partnering with other Patterson lawyers and its business leaders, this position is responsible for managing, and providing legal advice regarding a wide variety of litigation matters related to the company’s primary dental, animal health, and corporate business units. A core function of the role will be to manage debt recovery litigation. The objective of the role is to effectively advance or protect the Company’s business priorities while minimizing legal, financial and other (e.g. operational or reputation-based) exposure through formal and informal dispute resolution processes. The position requires the highest levels of performance and integrity combined with an ability to lead this work while participating in a highly collaborative Legal and Regulatory Affairs team.
A primary area of focus will be debt recovery efforts related to the dental and animal business units. In such matters, this position will manage formal and informal dispute resolution relating to debt recovery. This position will align external resources to represent the Company's interests in disputes with venues including trial courts and administrative agencies. The position will (a) actively manage outside counsel for strategic and economic resolution of litigation matters; (b) serve as counsel of record as necessary at the discretion of the General Counsel; (c) advise and counsel on pre-litigation matters, and (d) provide business counseling for compliance as well as risk mitigation. The position will lead comprehensive and timely work within the Company to support debt recovery litigation needs and other external investigation or dispute matters. The position will analyze issues, costs, proposed resolutions and prepare reports, summaries, and litigation management guidance for the General Counsel, the Legal team, the Regulatory Affairs team (as appropriate) and other Company leaders and managers. This position will focus on U.S. work but will support formal and informal dispute resolution in Canada as needs arise. At the discretion of the General Counsel, this position may also help the company respond to other, non-debt recovery, litigation and external enforcement investigations, inquiries or other processes.
Manage ongoing debt recovery efforts from delinquent accounts from inception through conclusion, including determination level of pursuit, managing bankruptcy litigation, obtaining financial judgments, etc.
Establish ROI track record to exceed current ROI on debt recovery
Develop appropriate case management systems to support debt recovery efforts
Direct outreach to debtors where Company collection effort is not productive
Handle incoming calls from debtors
Mange post-judgment efforts (i.e. with banks and credit collections processors)
Debt recovery efforts to include: communications with debtors and their counsel, monitoring of debtor payments to Company, managing local counsel (and related fees and expenses) as appropriate and research on debtor financial position
Draft, editing and managing documents used to minimize bad debt
Work regularly with Company employees who share in debt recovery processes
Retain and manage outside counsel to prosecute or defend lawsuits involving the Company in the U.S. (primary focus) and Canada (secondary focus)
Investigate underlying facts and legal precedent of disputed matters including the leading of document collection efforts
Draft or edit pleadings including motions, briefs, proposed orders, settlement agreements and other legal documents
Prepare witnesses to meet formal dispute resolution needs
Attend as needed, throughout the U.S. and Canada, depositions, hearings, mediations, arbitrations, settlement conferences, when appropriate to advance the Company’s interests
Represent, as assigned by the General Counsel, the Law Department at internal customer meetings and planning sessions
Manage outside counsel and related professional services to meet aggressive cost management targets
Maintain awareness with laws and regulations that affect debt collection practices such as the Fair Debt Collection Practices Act, related regulations, and state laws and regulations targeting debt collection practices
Work with corporate employment counsel, develop and manage litigation management processes for the Company’s Legal team (e.g. document preservation rules, subpoena handling, etc.)
Adhere to Department service levels and manage disputes and various priorities as a self-starter and leader
Provide attention to detail, timely responses, and prompt, accurate support and communications to Legal and Regulatory colleagues and Company leadership
Review contracts and agreements for key issues relevant to litigation and drafts and edits responses as needed
Identify recurring issues and patterns associated with litigation and other dispute matters and collaboratively create strategies to limit the Company’s exposure
The position will require some travel (anticipated at less than 10% of time)
Licensed to practice law in state and federal courts in Minnesota
8 or more years’ experience as a litigator, including writing substantial numbers of complex motions and briefs, participation in depositions, conducting investigations, and handling all aspects of trial work from inception through mediation, arbitration and trial
Excellent analytical, writing and communication skills
Excellent interpersonal skills
Ability to prioritize effectively and process a high volume of work in a timely manner
Strong ability to build rapport and deal effectively with disagreements
