Employment and Litigation Counsel
We are seeking a senior employment and litigation attorney to work on a wide variety of employment matters and defensive litigation support for the Company.
Employment matters will include being TiVo’s primary in-house employment law attorney. Specifically, the successful candidate will be responsible for maintaining Company compliance with applicable federal, state, local, and foreign employment laws and regulations. This position will work day-to-day with the Company’s human resources team on employment actions spanning entire employee lifecycle. Responsibilities include legal review of employee handbooks, template agreements for severance, releases and notifications, internal investigations, leaves of absence, ERISA plans, compensation and benefits matters, recruiting and training materials and other employee related matters. While TiVo primarily conducts all of this work in-house, there will be the occasional need to work with outside counsel based on project requirements and managing employment litigation and arbitrations.
Defensive litigation matters include responding to third-party inbound claims (e.g. interviewing witnesses, gathering, reviewing and analyzing relevant documents, and drafting responses to letters, discovery requests and briefs), working with the product teams and internal business leaders to resolve inbound claims, handling responses to third party subpoenas, and cost-effective, hands-on management of outside counsel. Prior experience with copyright (particularly the DMCA), trademark, trade secret and patent issues preferred. Based on company need, candidate aptitude and desire to be exposed to a variety of in-house legal work, there is potential for handling broader product counseling matters as well.
The candidate will work closely in a fast-paced and demanding environment with clients in other business groups as well as other members of the in-house legal team to identify issues and appropriate resolutions. This position will be responsible for exercising judgment to seek business solutions in light of risk implications, coordinating issue resolution and creative problem solving, dealing effectively with constituents within TiVo, and driving projects to closure.
Qualifications (What you’ll need to be successful):
JD with excellent academic credentials and California bar license or ability to practice in California as a registered in house counsel.
5+ years of experience in employment law counseling at a top law firm, with a mix of law firm and in-house legal experience preferred.
Prior commercial and copyright litigation experience at a technology company preferred.
You are well organized and hard-working, with the ability to thrive in a fast-paced collegial work environment and manage numerous projects simultaneously under deadline pressure.
You are intelligent, practical and business-oriented with experience helping companies adhere to the highest standard of ethics and compliance. The successful candidate must have excellent communication skills and personal confidence to be able to give legal opinions and risk assessment in a practical business oriented manner to senior executives, other members of the legal team and non-lawyer department representatives in the company in order to help reach solutions.
You possess a high-level of intellectual, professional and interpersonal agility and flexibility, combined with strong analytical and problem-solving skills and excellent writing skills.
Highly detail-oriented attorney with strong interpersonal and client service skills and proven ability to establish good professional relationships and credibility with internal clients, human resources teams, management, and legal colleagues.
