The Senior Legal Counsel – Data Privacy & Compliance will report to and assist the Associate General Counsel to ensure compliance with internal data privacy policies and applicable privacy laws and regulations of the US and Canada. The Sr. Legal Counsel will be responsible for developing and enhancing the Company's data privacy and compliance programs in the US and Canada. The position will interact with departments across the Company.
Build & Improve the Company's Data Privacy Program
Develop and coordinate an organization-wide privacy risk management and compliance framework and governance structure for the entities located in the US and Canada by undertaking a comprehensive review of the Company's data and privacy process and procedures for each applicable business function to ensure that they are consistent with relevant laws and regulations and the Company's privacy and data security goals and policies.
Develop, manage and assist in the implementation and maintenance of the Company's information privacy policies and procedures to ensure that business activities are consistent with them.
Collaborate with Global Information Security to ensure alignment between cyber security and privacy and data protection practices.
Collaborate with various contracting functions on privacy and data protection matters related to third party contracts.
In coordination with Associate General Counsel, serve as a liaison to regulatory and data protection authorities for matters relating to privacy and data protection.
Work with business teams and senior management to ensure awareness of "best practices" on privacy, data security and healthcare practice compliance issues.
Collaborate on cyber privacy and security policies and procedures.
Work with internal clients to develop strategic plans for the collection, use and sharing of information in a manner that maximizes its value while complying with applicable privacy regulations.
Assure that the use of technology maintains, and does not erode, privacy protections on use, collection and disclosure of personal information.
Monitor systems development and operations for security and privacy compliance.
Oversee data protection impact assessments and provide support for such assessments.
Develop, implement and train on the Company's Incident Response Plan
Mitigate effects of a use or disclosure of personal information by employees or business partners by ensuring the implementation of an incident response plan.
Manage compliance programs, including anti-bribery compliance, complex healthcare law, fraud and abuse, anti-kickback compliance, HIPAA compliance, and data privacy for all entities based in the US and Canada.
Advise internal business clients regarding how to implement initiatives in a manner that is consistent with compliance policies and best practices.
In collaboration with other departments (e.g., Information Security, Global Quality & Regulatory, IT) establish an internal privacy and data protection monitoring and audit program.
Update legal and compliance department colleagues on developments in the industry regarding significant or emerging legal and compliance risks.
Maintain knowledge of related legislative, regulatory and judicial developments and trends that may impact areas of responsibility and remain current with related global laws and regulations applicable to medical device manufacturers and healthcare practices.
JD and experience advising medical device manufacturers on data privacy, regulatory and compliance issues in a law firm and in-house setting is strongly desired.
Deep knowledge of privacy and data protection laws, regulations and best practices with particular emphasis in the healthcare, medical device and/or clinical research environments.
Minimum of 5-7 years of relevant experience with data privacy and compliance programs.
Excellent interpersonal skills and ability to work collaboratively, with a solution-oriented approach, in teams within legal, business, and functional areas.
High level of professionalism with strong judgement and commitment to ethical issues.
Strong verbal and written communication skills, effectively communicating sound legal advice coupled with a strong understanding of business needs.
Detail orientated with strong organizational skills and ability to handle multiple responsibilities simultaneously while maintaining high quality and performance under pressure.
Experience with building and implementing a local privacy program for medical or healthcare related practice.
Extensive experience and skill at writing policies and guidance documents supporting various business activities and conducting investigations.
IAPP Certifications such as CIPP/US, CIPP/E and/or CIPP/M a plus.
