The Global Head, Litigation and GovernmentInvestigations will facilitate Alcon Legal’s efforts to drive functional excellence in Litigation & Government Investigations by leading and managing government investigations, internal investigations, complex commercial litigation, commercial tort and products liability litigation. This associate will ensure internal business and global alignment relating to the handling of government investigations and other sensitive matters with substantial organizational risk.
The Global Head will also collaborate and partner with senior lawyers and Compliance professionals to provide strategic guidance and solutions to protect and mitigate risk to the organization, based on active government investigations, as well as, litigation facing the Company. This associate will have budgetary responsibly for matters potentially material to the business. This role, in conjunction with department head, will be the primary legal support for all government investigations and complex litigation. This position, at present also is responsible for the Global Records Management function. Additionally, this attorney is responsible for eDiscovery issues and is the primary point of contact for legal document retention issues, discovery issues and the Alcon representative on the eDiscovery Center of Excellence.
The Global Head, Litigation and GovernmentInvestigation will have the following specific responsibilities:
Act as a primary divisional counsel on government investigations.
Manage outside counsel on conducting investigations, including providing strategic and tactical direction, and management of substantial budgets.
Interact with government and regulatory authorities as appropriate, including, participation in meetings with government officers to present findings of internal inquiries, disclosures, settlement/resolution discussions, and any other matters requiring direct contact with investigating/enforcement agencies (US/Global)
Collaborate with other departments in Alcon Legal (Regulatory & Development, Global Transactions, Compliance, Trade Compliance, etc.) in this capacity as subject matter expert on investigations.
Coordinate with Corporate or Group level functions, as appropriate for government investigations.
Manage and facilitate responses to subpoenas, civil investigative demands, or other inquiries made by governmental agencies or authorities.
Provide substantive updates to internal and external stakeholders on investigations and potential risks posed by investigations, either directly against Alcon or against any Novartis Group affiliates.
Maintain current knowledge of applicable laws, regulations and industry guidance relevant to role and risks to organization.
Provide substantive legal counsel to senior management and the Legal Department as a whole, across all franchises globally. Including, but not limited to:
Setting and communicating standards, developing training/communications to provide awareness and understanding of eDiscovery, records retention and best practices related to litigation, either directly or through collaboration with internal colleagues;
Trains and advises management, and advises on new legal trends, enforcement activity and legislation in relevant assigned areas;
Act as subject matter expert on discovery issues and lead Global Records Management Function;
As assigned, leading and managing a variety of complex commercial litigation matters, many with substantial potential monetary and reputational impact to Alcon and Novartis.
Work with internal clients to gather information and documentation necessary for litigation;
Prepare internal associates for deposition, trial or other events relating to the litigation of company matter.
Attend hearings, trials or other events of significant importance to litigation matters.
Manage budgets and conduct of outside legal counsel.
15+ years of relevant prior legal experience, with experience counseling multi-national healthcare companies (pharmaceutical/medical device) on litigation and investigations.
5+ defending companies in governmental investigations.
