Global pharmaceutical company is seeking an experienced pharmaceutical attorney to support the company’s US Biopharmaceuticals (BioPharm) division. This attorney will be based in Central New Jersey and be a member of the BioPharm legal team, reporting to the VP –BioPharm Legal, with primary responsibility for supporting the Managed Markets operations of the BioPharm division and the company. As the primary attorney with this responsibility, this attorney will: i) focus on specific issues related to the managed care market place, including relationships with PBMs, GPOs, group medical practice, etc.; ii) draft, negotiate and provide tactical and strategic advice regarding commercial contracts, with particular emphasis on managed markets agreements, particularly in the “buy and bill” area and (iii) advise his or her internal clients on various programs in a way that advances the company’s strategy while addressing legal/regulatory risks and preserving/protecting the company’s integrity and reputation. In addition, other work to support the US BioPharm will focus on a broad range of legal, regulatory and compliance issues, including False Claims Act, Kickback Statute, OIG guidance, and the PhRMA Code, and will require cross-functional collaboration with many other departments within US BioPharm and within the company as a whole.
Primary member of the Legal team responsible for partnering with the business on assigned projects to evaluate and counsel on both tactical and strategic matters
Identifies legal issues related to assigned matters; develops alternative solutions and facilitates the implementation of resolutions
Drafts, reviews and negotiates managed markets contracts, as well as various vendor agreements and consulting agreements as needed
Timely responds to and identifies solutions for day-to-day questions raised by clients
Interacts with various departments across the organization, including but not limited to, sales, marketing, reimbursement, managed markets contracting, managed markets strategy, and government pricing functions
Serves as a business partner in support of key customer group(s) with minimal oversight and guidance from managing attorney
Keeps informed of new laws, regulations, and industry trends affecting the company, and assists with development of policies and training as needed
Law (JD degree) Candidates should be licensed to practice law in New Jersey or eligible to obtain a limited license for in-house counsel
At least 10 – 15+ years of relevant commercial pharmaceutical industry experience with a major corporation or law firm strongly preferred
Health law expertise (FDA regulations and guidances; federal and state kickback laws; the prohibition against off-label promotion; FCPA; False Claims Act) to advise the business
Knowledge of the managed markets/payer industry, such as PBMs, rebate agreements, specialty pharmacies and related payer groups, as well as Medicare
Experience supporting managed markets teams
Experience with government price reporting preferred.
Exceptional written and verbal communications skills – able to effectively collaborate and communicate with stakeholders throughout the company
Demonstrated ability to perform successfully in cross-functional teams, with the ability to lead and influence
Excellent time management skills with proven ability to work on multiple projects at any given time in a fast-paced, nimble environment
